{"id":17613,"date":"2014-09-03T11:40:43","date_gmt":"2014-09-03T14:40:43","guid":{"rendered":"http:\/\/www.rioonwatch.org\/?p=17613"},"modified":"2017-05-11T10:00:17","modified_gmt":"2017-05-11T13:00:17","slug":"criminalization-militarization-and-the-normalized-absurdities-that-condemned-rafael-braga-vieira","status":"publish","type":"post","link":"https:\/\/rioonwatch.org\/?p=17613","title":{"rendered":"Criminalization, Militarization and the Normalized Absurdities that Condemned Rafael Braga Vieira"},"content":{"rendered":"<p>A debate held on August 20 at Rio\u2019s Fluminense Federal University (UFF) sought to explore the issues of <a href=\"http:\/\/bit.ly\/1vF52R1\" target=\"_blank\" rel=\"noopener noreferrer\">police violence and the criminalization of poverty and social movements<\/a> in the wake of the widely disputed conviction of Rafael Braga Vieira. Braga, 26, is a <a href=\"http:\/\/bit.ly\/1rnXZ0W\" target=\"_blank\" rel=\"noopener noreferrer\">black<\/a> homeless man who was taken into custody after he was found in the possession of two plastic bottles of liquid detergent during the mass <a href=\"http:\/\/bit.ly\/1owU22I\" target=\"_blank\" rel=\"noopener noreferrer\">protests<\/a> in June 2013. He was\u00a0<a href=\"http:\/\/bit.ly\/1A2avSv\" target=\"_blank\" rel=\"noopener noreferrer\">found guilty<\/a> of carrying an \u201cexplosive or incendiary device, without authorization or in breach of legal or regulatory determination.\u201d<\/p>\n<p>The event welcomed Thiago Melo, lawyer and director of the <a href=\"http:\/\/bit.ly\/JKFcsr\" target=\"_blank\" rel=\"noopener noreferrer\">Human Rights Defenders Institute<\/a>, Police Commissioner Orlando Zaccone, and Henrique Vieira, theologian and City Councilor, to discuss the issues surrounding the relationship between police and civilians.<\/p>\n<h3>The\u00a0mechanisms of criminalization<\/h3>\n<p>Melo provided a wide scope of criminalization mechanisms, in various facets which are not solely judicial. He broke down the concept of\u00a0\u2018criminalization\u2019 into several types of discrimination that work to\u00a0delegitimize\u00a0the most vulnerable groups of people in society:<\/p>\n<ol>\n<li>Caricaturization: depicting vulnerable members of society as worthless or\u00a0despicable;<\/li>\n<li>Disqualification: distorting protesters\u2019 and movements\u2019 agendas, proposals and claims;<\/li>\n<li>Inferiorization: diminishing orders of numbers and statistics;<\/li>\n<li>Invisibilization: reducing diversity (for example, failing to recognize the existence of different groups);<\/li>\n<li>Individualization: disregarding collective claims, shrinking them to individual ones instead;<\/li>\n<li>Co-optation: buying, absorbing or neutralizing actors;<\/li>\n<li>Omission: endangering state-provided protection systems of lawyers or magistrates.<\/li>\n<\/ol>\n<p>Melo\u2019s\u00a0approach\u00a0describes a varied process\u00a0involving actors (e.g. politicians, certain media outlets)\u00a0with\u00a0a common goal of silencing struggles, disempowering and repressing parts of society, while appealing to and gaining the consent of the privileged rest.<\/p>\n<h3>The expediency of emergency<\/h3>\n<p>The justification of such maneuvers can only be achieved\u00a0with a well-constructed and sustained claim to a \u201c<a href=\"http:\/\/bit.ly\/1qyn1XD\" target=\"_blank\" rel=\"noopener noreferrer\">state of emergency<\/a>,\u201d explained professor and theologian Henrique Vieira.<\/p>\n<p>Vieira retraced some of the steps and episodes that led to the current normalized \u201cemergency\u201d in dealing with <a href=\"http:\/\/bit.ly\/1qmdZhK\" target=\"_blank\" rel=\"noopener noreferrer\">mega-events controversies<\/a>.<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2013\/06\/police-op1.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-9800 size-content\" title=\"Shock troops repress protest in June last year. Photo by Sergio Moraes\/Reuters\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2013\/06\/police-op1-620x264.jpg\" alt=\"\" width=\"620\" height=\"264\" \/><\/a><\/p>\n<p>To emphasize the depth of \u2018crimi-litarization\u2019 in Brazilian history, Vieira read excerpts from an\u00a0<a href=\"http:\/\/bit.ly\/1nSPcx6\" target=\"_blank\" rel=\"noopener noreferrer\">1888 National Congress speech<\/a>. The &#8220;poor and vicious classes\u201d are <a href=\"http:\/\/bit.ly\/1hwDJW7\" target=\"_blank\" rel=\"noopener noreferrer\">blamed of all evil in society<\/a>, and \u201ceven when vice is not accompanied by crime,\u201d the sole condition of poverty \u201cconstitutes a rightful reason of terror for the society.\u201d<\/p>\n<p>This rhetoric was repeated when Vieira deconstructed a 2008 TV commercial\u00a0where an armored vehicle drives up a favela, dropping off the police first and all other public agents (doctors, social workers, etc.) second. A voice proclaims: \u201cSecurity: the entrance door for citizenship.&#8221;<\/p>\n<p>As the audience contributed to the discussion, the concluding remarks called for a redefinition of peace, and for the\u00a0democratization of the police\u2013by means of transparency, accountability and checks on power. It was also concluded that the \u201cwar on drugs\u201d must end and that the establishment must shift to alternative solutions like legalization and regulation, based around the concepts of autonomy and health.<\/p>\n<h3>The case of Rafael Braga Vieira<\/h3>\n<p>Framed in this context, Braga&#8217;s\u00a0<a href=\"http:\/\/on.fb.me\/1nSRaNZ\" target=\"_blank\" rel=\"noopener noreferrer\">five year sentence<\/a> (reduced to 4 years and 8 months <a href=\"http:\/\/bit.ly\/1A2bfat\" target=\"_blank\" rel=\"noopener noreferrer\">after human rights association DDH appealed on his behalf<\/a>) for the crime of carrying cleaning products illustrates how any underprivileged member of society could fall victim the \u2018crimi-litarization\u2019 machine.<\/p>\n<p><a href=\"http:\/\/bit.ly\/1w3sgk1\" target=\"_blank\" rel=\"noopener noreferrer\">In the words<\/a> of State Deputy and head of the State of Rio&#8217;s Human Rights Commission,\u00a0<a href=\"http:\/\/bit.ly\/11lFhqQ\" target=\"_blank\" rel=\"noopener noreferrer\">Marcelo Freixo<\/a>:\u00a0\u201cRafael Braga Vieira is young, black, poor, illiterate, homeless, from the peripheries of Rio de Janeiro. He doesn&#8217;t represent an exception, <a href=\"http:\/\/bit.ly\/XComj7\" target=\"_blank\" rel=\"noopener noreferrer\">but a norm<\/a>.\u201d<\/p>\n<p>To further illustrate Braga&#8217;s case as a norm for young black people in Brazil, it is important to note that he was the only person to be convicted for a crime during the 2013 protests.<\/p>\n<p>\u201cIt&#8217;s not possible to stay blind, deaf and mute in the face of gross injustice,\u201d said Freixo at the Rio State Legislative Assembly\u00a0plenary session on August 26. &#8220;[Braga] is another one: one more invisible, poor, vulnerable, black, illiterate person that our logic of justice has condemned to what seems to be the only destiny left [to him] in our market society.
