{"id":28781,"date":"2016-05-13T09:33:54","date_gmt":"2016-05-13T12:33:54","guid":{"rendered":"http:\/\/www.rioonwatch.org\/?p=28781"},"modified":"2020-08-07T14:04:03","modified_gmt":"2020-08-07T17:04:03","slug":"vito-giannotti-occupation-in-the-port-region-faces-uncertainty-and-legal-pressure","status":"publish","type":"post","link":"https:\/\/rioonwatch.org\/?p=28781","title":{"rendered":"Vito Giannotti Occupation in the Port Region Faces Uncertainty, Legal Pressure"},"content":{"rendered":"<p style=\"text-align: right;\"><a href=\"http:\/\/bit.ly\/22hVtrs\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><em>Clique aqui para Portugu\u00eas<img decoding=\"async\" width=\"20\" height=\"20\" class=\"alignright size-full wp-image-23766\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2012\/08\/PT-e1439583827971.png\" alt=\"\" \/><\/em><\/strong><\/a><\/p>\n<p><span style=\"font-weight: 400;\">During the final week of April, the occupants of the <a href=\"http:\/\/bit.ly\/1TRhmuc\" target=\"_blank\" rel=\"noopener noreferrer\">Vito Giannotti Occupation<\/a> received news of the\u00a0latest obstacle in their fight to turn a previously abandoned hotel into subsidized <a href=\"http:\/\/bit.ly\/1WsMjG9\" target=\"_blank\" rel=\"noopener noreferrer\">affordable housing<\/a> units: a \u201cwrit of repossession\u201d from a judge that would force residents to leave and would turn the building back over to the Brazilian Social Security Administration (INSS). \u00a0May marks the fourth month of the occupation, located in the Santo Cristo neighborhood of <a href=\"http:\/\/bit.ly\/1iwThVm\" target=\"_blank\" rel=\"noopener noreferrer\">Rio\u2019s Port Region<\/a>. \u00a0Over the past few months political uncertainty at the local and federal levels, lack of access to basic resources like water, food and supplies, and security concerns have been significant\u00a0obstacles for the occupation in its fight. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe know that the whole city of Rio de Janeiro, especially the port area, is undergoing many changes related to the city&#8217;s preparation for the <a href=\"http:\/\/bit.ly\/1pXMFVa\" target=\"_blank\" rel=\"noopener noreferrer\">Olympics<\/a>, a process marked by <a href=\"http:\/\/bit.ly\/1Tg0lMI\" target=\"_blank\" rel=\"noopener noreferrer\">forced evictions<\/a>, <a href=\"http:\/\/bit.ly\/1OjlWNM\" target=\"_blank\" rel=\"noopener noreferrer\">gentrification<\/a> and high increase in the cost of living for the entire population, especially in relation to <a href=\"http:\/\/bit.ly\/1hQoPdL\" target=\"_blank\" rel=\"noopener noreferrer\">housing<\/a>,&#8221; explained the occupation&#8217;s communications director\u00a0P\u00e2mela Sall.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Faced with a troubled political context, the Vito Giannotti Occupation has expressed its appeal &#8220;to guarantee the <a href=\"http:\/\/bit.ly\/1SsnfR0\" target=\"_blank\" rel=\"noopener noreferrer\">right to the city<\/a> and to decent <a href=\"http:\/\/bit.ly\/1zOpGkf\" target=\"_blank\" rel=\"noopener noreferrer\">housing<\/a>,\u201d says the group\u2019s <a href=\"http:\/\/on.fb.me\/1SxcETW\" target=\"_blank\" rel=\"noopener noreferrer\">Facebook page<\/a>, which provides updates on the status of the occupation as well as support occupants request. \u00a0<\/span><\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2016\/05\/12998710_1758878874331655_2420889652421546133_n.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-28782 size-content\" title=\"The occupation runs classes and activities for children. Image from Ocupa\u00e7\u00e3o Vito Giannotti Facebook page \" width=\"620\" height=\"264\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">The occupation is a joint effort by four prominent, national <a href=\"http:\/\/bit.ly\/1OwGC6K\" target=\"_blank\" rel=\"noopener noreferrer\">social movements<\/a> that came together with the goal of securing\u00a0<a href=\"http:\/\/bit.ly\/1KyrzGq\" target=\"_blank\" rel=\"noopener noreferrer\">Minha Casa Minha Vida-Entidades (MCMV-En) <\/a>\u00a0funding to develop housing solutions. MCMV-En is a small part of the <a href=\"http:\/\/bit.ly\/1lTMw0y\" target=\"_blank\" rel=\"noopener noreferrer\">Minha Casa Minha Vida<\/a>\u00a0federal housing program and\u00a0funds\u00a0social movements and collectives develop\u00a0their own housing projects. <\/span><span style=\"font-weight: 400;\">The process of applying for this funding is long and difficult.\u00a0The\u00a0<a href=\"http:\/\/bit.ly\/1xc7Vv7\" target=\"_blank\" rel=\"noopener noreferrer\">Manoel Congo occupation<\/a>\u00a0in downtown Rio\u00a0waited more than nine years to be granted this status. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Beyond the fight for housing, Vito Giannotti\u00a0has larger political and cultural motives: the space has become a collective meeting place for social movements and holds activities for children in the surrounding communities.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To prepare to apply for MCMV-En funding, the social movements and people occupying the building are preparing a report for the Caixa Federal Bank and the Ministry of Cities. The occupation is leveraging the social movements&#8217; nationwide networks and has already had meetings with officials in Bras\u00edlia. The report will contain information on the building, project and budgetary considerations, the larger goals and objectives as well as more information about the people who\u00a0will live there.<\/span><\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2016\/05\/IMG_3348.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-28783 size-content\" title=\"Residents are currently working to remodel the space, but are uncertain of if they will be able to stay. They are enlisting the help of a network of lawyers and urbanists who support the occupation as well as an architect who resides there. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">After this phase, MCMV-En applicants have to pass through a technical evaluation process. The Vito Gianotti occupation, however, has already received a structural evaluation from Rio\u2019s city government. Theoretically, it could pass through this phase quickly, but\u00a0it still needs to pass through the primary selection process to be in consideration for MCMV-En funding. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The recent court ruling to return ownership status of the hotel to the INSS agency is a challenge and has slowed down the application. Occupants do not have access to a reliable water source and have to bring water for showers and cooking daily, but they say that the hardest part of the occupation is the constant uncertainty of whether they will be able to stay in the building or not.<\/span><\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2016\/05\/13116305_1767889893430553_5735570537672859401_o.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-28784 size-content\" title=\"The Occupation receives guests and supporters to spread the word about their fight. Firstly, they ask that the INSS and the Ministry of Cities respect the designation of the building as affordable housing, which was given years ago. Secondly, they are requesting that the INSS stop the repossession process, meaning the occupation can regain legal access to the building. They would like to move forward with the INSS in ongoing negotiations about how to best transfer the property from the INSS to the Caixa bank and then the Ministry of Cities, which is ultimately in charge of the MCMV-En designation and funding. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201c<\/span><span style=\"font-weight: 400;\">The Vito Giannotti Occupation will resist to keep the struggle alive for decent housing and the social use of abandoned property in the city. Remember that the port area is undergoing enormous changes, in order to attract big capital, accompanied by a gentrification process that deprives\u00a0the local and least favored of any benefits that rampant development can bring.\u201d<\/span><\/p>\n<p>Currently, members of the occupation have returned to the judge with an interlocutory appeal to stop the repossession. \u00a0As of May 9, the appeal was granted to the occupation, which leaves the INSS 10 days to respond whether the occupation can continue or not. Occupants are awaiting this response. \u00a0The social movements are continuing to negotiate and make their case to the INSS officials to remain in the hotel and continue renovations.<\/p>\n<p>On May 11, the occupation launched an online petition to request the INSS allow the occupation to remain.
