{"id":31882,"date":"2016-08-17T08:00:22","date_gmt":"2016-08-17T11:00:22","guid":{"rendered":"http:\/\/www.rioonwatch.org\/?p=31882"},"modified":"2020-08-07T14:03:50","modified_gmt":"2020-08-07T17:03:50","slug":"horto-receives-90-day-eviction-notice-just-as-housing-groups-hoped-for-post-olympic-calm","status":"publish","type":"post","link":"https:\/\/rioonwatch.org\/?p=31882","title":{"rendered":"Horto Receives 90-Day Eviction Notice, Just as Housing Groups Hoped for Post-Olympic Calm"},"content":{"rendered":"<p style=\"text-align: right;\"><a href=\"http:\/\/bit.ly\/2bAaCSA\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><em>Clique aqui para Portugu\u00eas<img decoding=\"async\" width=\"20\" height=\"20\" class=\"alignright size-full wp-image-23766\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2012\/08\/PT-e1439583827971.png\" \/><\/em><\/strong><\/a><\/p>\n<p>Housing rights groups had hoped that the arrival of the <a href=\"http:\/\/bit.ly\/1pXMFVa\" target=\"_blank\" rel=\"noopener noreferrer\">Olympic Games<\/a> would bring an end to\u00a0the <a href=\"http:\/\/bit.ly\/2aZ4Jfn\" target=\"_blank\" rel=\"noopener noreferrer\">painful<\/a> and <a href=\"http:\/\/bit.ly\/1JnWsNg\" target=\"_blank\" rel=\"noopener noreferrer\">extraordinary<\/a>\u00a0period of forced evictions Rio has experienced since the city was selected to host the\u00a0Games, back in October 2009.<\/p>\n<p>Yet a federal court announced on Wednesday, August 10, that Rio&#8217;s\u00a0Botanical Garden will have <a href=\"http:\/\/glo.bo\/2bC3nwG\" target=\"_blank\" rel=\"noopener noreferrer\">90 days<\/a> to remove the\u00a0<a href=\"http:\/\/bit.ly\/1KPjJvO\" target=\"_blank\" rel=\"noopener noreferrer\">Horto<\/a>\u00a0favela\u00a0in the <a href=\"http:\/\/bit.ly\/1pfz23A\" target=\"_blank\" rel=\"noopener noreferrer\">South Zone<\/a> of Rio de Janeiro, striking a blow to the <a href=\"http:\/\/bit.ly\/1vftQzk\" target=\"_blank\" rel=\"noopener noreferrer\">longstanding effort<\/a> to secure the community\u2019s permanence. The Federal Court of Accounts (TCU) established the time period against the advice of experts, who suggested a minimum of 180 days to complete the process. As of last week the Botanical Garden had promised no compensation to residents set to lose their homes, despite the objections of Minister Bruno Dantas, who contended that the <a href=\"http:\/\/bit.ly\/1pO06YP\" target=\"_blank\" rel=\"noopener noreferrer\">evictions<\/a>\u00a0should not take place before a compensation agreement is met.<\/p>\n<p>Horto, a community of 621 families, was <a href=\"http:\/\/bit.ly\/29bDIsr\" target=\"_blank\" rel=\"noopener noreferrer\">founded 200 years ago<\/a> when King Jo\u00e3o VI invited workers building\u00a0the Botanical Garden to live on the adjacent property. Generations of Botanical Garden employees have lived in Horto, many of whom received housing in lieu of monetary compensation. The community has faced <a href=\"http:\/\/bit.ly\/1vftQzk\" target=\"_blank\" rel=\"noopener noreferrer\">several removal efforts<\/a> by the governing committee of the Botanical Garden, with evictions threats dating back to the 1960s.<\/p>\n<p>Last week\u2019s announcement comes after a prolonged period of uncertainty following the <a href=\"http:\/\/bit.ly\/ImpeachmentSeries\" target=\"_blank\" rel=\"noopener noreferrer\">suspension of President Dilma Rousseff<\/a>. Over 200 families filed lawsuits against the Botanical Garden, a national park, for serving eviction notices <a href=\"http:\/\/bit.ly\/21TazCb\" target=\"_blank\" rel=\"noopener noreferrer\">earlier this year<\/a>. A <a href=\"http:\/\/bit.ly\/1VYR37j\" target=\"_blank\" rel=\"noopener noreferrer\">series of demonstrations<\/a> in March drew hundreds of residents and supporters to protest the eviction of several elderly residents that was\u00a0later postponed. The case has been in litigation in Bras\u00edlia for months, but was delayed by the political turmoil in the federal government. Residents considered President Rousseff\u2019s administration to be their best chance to resist removal, as the government had been actively supporting the community\u2019s efforts.<\/p>\n<p>Following the installation of interim President Temer, Horto Neighborhood\u00a0Association President Emerson de Souza reported that residents had difficulty contacting representatives in the Temer administration regarding their case. Representatives from the Botanical Garden have refused to communicate directly with residents, opting instead to deliver eviction notices and updates through armed shock troops.<\/p>\n<p>While the Botanical Garden claims to need the land to <a href=\"http:\/\/bit.ly\/1vftQzk\" target=\"_blank\" rel=\"noopener noreferrer\">expand its research institute<\/a>, residents contend they are being forced out due to <a href=\"http:\/\/bit.ly\/1k5BsNq\" target=\"_blank\" rel=\"noopener noreferrer\">real estate speculation<\/a>. The community abuts the growing Jardim Bot\u00e2nico neighborhood, a chic district peppered with gated condominiums and expensive bistros as well as media giant Globo\u2019s headquarters. Residents of Horto have frequently criticized <a href=\"http:\/\/bit.ly\/1YgEEPz\" target=\"_blank\" rel=\"noopener noreferrer\">Globo<\/a> for what they perceive as a vested interest in the community\u2019s removal. Globo has reported Horto\u2019s property as being worth <a href=\"http:\/\/glo.bo\/1TonBqA\" target=\"_blank\" rel=\"noopener noreferrer\">R$10.6 billion<\/a> and characterized the community in a recent headline as an \u201cirregular occupation.\u201d A number of Globo executives, including Grupo Globo vice president Jos\u00e9 Roberto Marinho, serve on the Friends of the Botanical Garden\u00a0Association.<\/p>\n<p>Residents, however, refute the narrative of \u201cinvasion\u201d and emphasize their strong, historic connection with the land. Neuza Carcerere, 65, was born and raised in Horto and explained: \u201cFor me, the value of this land is not monetary. The value of this land for the people here is the <a href=\"http:\/\/bit.ly\/29bDIsr\" target=\"_blank\" rel=\"noopener noreferrer\">history<\/a> and the community.\u201d<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2016\/08\/DSC_0032.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-31884 size-content\" title=\"Neuza Carcerere, 65, was born and raised in Horto. Pointing to mansions built on the nearby hillside, de Souza commented that while those houses circumvented the strict zoning ordinances in the <a href=\"http:\/\/bit.ly\/1OnF6o1\" target=\"_blank\" rel=\"noopener noreferrer\">Tijuca National Park<\/a> they have never been described as \u201cillegal\u201d or \u201coccupations\u201d by Globo. \u201cThese laws only apply to the working class,\u201d she said.<\/p>\n<p>Residents argued that delivering the eviction notice during the <a href=\"http:\/\/bit.ly\/1pXMFVa\" target=\"_blank\" rel=\"noopener noreferrer\">Olympics<\/a> was an attempt to evade media coverage. In a <a href=\"http:\/\/bit.ly\/2b1gh3d\" target=\"_blank\" rel=\"noopener noreferrer\">statement released online<\/a>, the Neighborhood Association wrote, \u201cWe are not against the Olympics, much to the contrary, we are against the dismantling of constitutional rights of the working class.
