{"id":35206,"date":"2017-03-13T11:36:57","date_gmt":"2017-03-13T14:36:57","guid":{"rendered":"http:\/\/www.rioonwatch.org\/?p=35206"},"modified":"2023-08-23T12:20:37","modified_gmt":"2023-08-23T15:20:37","slug":"brazils-new-land-regularization-law-a-territorial-attack-on-several-fronts","status":"publish","type":"post","link":"https:\/\/rioonwatch.org\/?p=35206","title":{"rendered":"Brazil&#8217;s New Land Regularization Law: A Territorial Attack on Several Fronts"},"content":{"rendered":"<p style=\"text-align: right;\"><a href=\"http:\/\/bit.ly\/2lLenXY\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><em>Clique aqui para Portugu\u00eas<img decoding=\"async\" width=\"20\" height=\"20\" class=\"alignright size-full wp-image-23766\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2012\/08\/PT-e1439583827971.png\" alt=\"\" \/><\/em><\/strong><\/a><\/p>\n<p><em>For the original article by Luciana Bedeschi and Paulo Romeiro\u00a0in Portuguese published by Nexo click <a href=\"http:\/\/bit.ly\/2lLenXY\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>.<\/em><\/p>\n<h4><strong>What is being sold as an attempt to reduce bureaucracy and increase efficiency in the management of public assets, in practice hides the possibility of transferring these assets and natural resources to private interests without any social or collective interest\u00a0criteria.<\/strong><\/h4>\n<p>At the end of last year, the [federal] government issued <a href=\"http:\/\/bit.ly\/2kSEq2b\" target=\"_blank\" rel=\"noopener noreferrer\"><span class=\"il\">Provisional\u00a0<\/span><span class=\"il\">Measure<\/span>\u00a0759\/16<\/a>\u00a0(MP 759\/16), supposedly aimed at facilitating<span class=\"il\">\u00a0<\/span>regularization of urban and rural lands. Analyses of the Measure&#8217;s urban and rural aspects, however, show that behind this proposal there is an attempt to commercialize the <span class=\"il\">land<\/span> occupied by agrarian reform settlements and informal urban settlements, amnesty given to irregular high-level occupations, in addition to the sale of the government&#8217;s real estate assets, without any social or collective interest criteria.<\/p>\n<p>The <a href=\"http:\/\/bit.ly\/2m3NRdf\" target=\"_blank\" rel=\"noopener noreferrer\">hegemonic media<\/a> and entities such as <a href=\"http:\/\/bit.ly\/2jjH8NY\" target=\"_blank\" rel=\"noopener noreferrer\">Irib<\/a> (Brazilian Real Estate Registry Institute), <a href=\"http:\/\/bit.ly\/2m0iI9T\" target=\"_blank\" rel=\"noopener noreferrer\">CAU<\/a> (Architecture and Urbanism Council) and the <a href=\"http:\/\/bit.ly\/2mCMo0y\" target=\"_blank\" rel=\"noopener noreferrer\">National Confederation of Municipalities<\/a> reproduced the official speech, apparently repeating information released by the Ministry of Cities, and <a href=\"http:\/\/bit.ly\/2nfGRdi\" target=\"_blank\" rel=\"noopener noreferrer\">celebrating<\/a> the Measure. However, social movements from the countryside and the city are beginning to present their counter-narrative, which is fundamental being that the real objectives and consequences of the adoption of this <span class=\"il\">Provisinoal<\/span>\u00a0<span class=\"il\">Measure<\/span> are not clearly stated in the official discourse.<\/p>\n<p>The MST (Landless Workers&#8217; Movement), for example, has already opposed the <span class=\"il\">Provisional<\/span>\u00a0<span class=\"il\">Measure<\/span> through the <a href=\"http:\/\/bit.ly\/2n7LY07\" target=\"_blank\" rel=\"noopener noreferrer\">Fortaleza Charter<\/a>, issued at the end of January, in which it denounces the privatization of <span class=\"il\">land<\/span> for agrarian reform. The movement positioned itself on the question as follows: &#8220;We are against and will fight against Provisional\u00a0<span class=\"il\">Measure<\/span>\u00a0759 of the retrogression of Agrarian Reform, which privatizes lands destined to agrarian reform, transforming them into a commodity, legalizing public <span class=\"il\">land<\/span>-grabbers and excluding from the process workers camped in settlements.&#8221; The MST also condemns &#8220;the privatization of <span class=\"il\">land<\/span>, disguised as titling,&#8221; in reference to the Measure&#8217;s\u00a0proposal of individual titling through the transfer of property, and the possibility of settlement <span class=\"il\">land<\/span> sales.\u00a0Given the current economic situation and the capacity for acquiring debt\u00a0of the settlers, the sale will be unavoidable, once this possibility is opened, given the economic pressure imposed by the expansion of agribusiness.<\/p>\n<p>On February 1, the <a href=\"http:\/\/bit.ly\/2mCZPOd\" target=\"_blank\" rel=\"noopener noreferrer\">debate<\/a> &#8220;<span class=\"il\">Land<\/span> regularization in Brazil: what&#8217;s at stake?&#8221; took place, hosted by the IAB (Brazilian Institute of Architects) and IBDU (Brazilian Institute on Urban Law) with support from the P\u00f3lis Institute, in which it was evidenced that the Measure intends to <span class=\"il\">attack<\/span> the <span class=\"il\">land<\/span> issue in Brazil on <span class=\"il\">several<\/span> <span class=\"il\">fronts<\/span>.<\/p>\n<blockquote><p>&#8220;The complexity and the breadth of issues at stake go far beyond claims to facilitate <span class=\"il\">land<\/span> regularization of informal urban settlements and agrarian reform settlements.&#8221;<\/p><\/blockquote>\n<p>It was shown that there is a clear intention to privatize lands belonging to the federal government. With the justification for this being the need to increase tax collection&#8211;without meeting social or collective interest criteria and ignoring <a href=\"http:\/\/bit.ly\/1OzrB24\" target=\"_blank\" rel=\"noopener noreferrer\">the principle of a property&#8217;s social function<\/a>, which should guide <span class=\"il\">land<\/span> policy&#8211;the Measure&#8217;s proposal expressly aims to institute mechanisms to improve the efficiency of the procedures for the disposal of government real estate. In this case, what is being sold as an attempt to reduce bureaucracy and increase efficiency in the management of public assets, in practice hides the possibility of transferring these assets and natural resources without any social or collective interest criteria, since the government will have <em>carte blanche<\/em> to dispose of these properties. A perverse effect of this possibility of alienation without any criteria will be, for example, the <span class=\"il\">legalization<\/span> of public <span class=\"il\">land<\/span> grabbing, including in the Legal Amazon, representing a serious threat to Brazilian environmental assets and traditional ways of life.<\/p>\n<p>Another central issue of <a href=\"http:\/\/bit.ly\/2ooRyvF\" target=\"_blank\" rel=\"noopener noreferrer\">this Provisional\u00a0<span class=\"il\">Measure<\/span><\/a> is that it prioritizes the <span class=\"il\">land<\/span> regularization of high-standard occupations, such as private condominiums and subdivisions in areas of environmental preservation, without any counterweight. With the conversion of Measure\u00a0into law, for example, private condominiums, which in reality were approved as a subdivision and, therefore, should provide their streets and squares for public use will be regularized without any offset, which will mean the privatization of public spaces, which all could enjoy, resulting in even greater socio-<span class=\"il\">territorial<\/span> segregation in the cities.<\/p>\n<p>It is for\u00a0this reason that last week a number of entities published\u00a0<a href=\"http:\/\/bit.ly\/2n032s2\" target=\"_blank\" rel=\"noopener noreferrer\">a public letter<\/a>\u00a0entitled &#8220;Provisional\u00a0<span class=\"il\">Measure<\/span> No. 759\/2016: The deconstruction of <span class=\"il\">land<\/span> regularization in Brazil,&#8221; systematizing the Measure&#8217;s main problems discussed at the aforementioned event. The letter points out the complexity of the issues raised by the bill and the breadth of the issues at stake, which go far beyond claims to facilitate <span class=\"il\">land<\/span> regularization of informal urban settlements and agrarian reform settlements. MP 759\/2016 represents an assault on <span class=\"il\">several<\/span> <span class=\"il\">fronts<\/span> of the Brazilian territory, as it deepens the process of Brazil&#8217;s privatization and prevents democratic access to <span class=\"il\">land<\/span> in cities, in the countryside and in the Legal Amazon.<\/p>\n<p><em>Luciana Bedeschi is a lawyer, Master in urban and environmental law by PUC-SP, and doctoral candidate in Territorial Planning and Management at UFABC.
