{"id":36353,"date":"2017-05-11T10:21:39","date_gmt":"2017-05-11T13:21:39","guid":{"rendered":"http:\/\/www.rioonwatch.org\/?p=36353"},"modified":"2017-05-16T07:58:13","modified_gmt":"2017-05-16T10:58:13","slug":"protesters-demand-freedom-for-rafael-braga-symbol-of-brazils-criminalization-of-poverty","status":"publish","type":"post","link":"https:\/\/rioonwatch.org\/?p=36353","title":{"rendered":"Protesters Demand Freedom for Rafael Braga, Symbol of Brazil&#8217;s Criminalization of Poverty"},"content":{"rendered":"<p style=\"text-align: right;\"><a href=\"http:\/\/bit.ly\/2qnbtyE\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><em>Clique aqui para Portugu\u00eas<img decoding=\"async\" width=\"20\" height=\"20\" class=\"alignright size-full wp-image-23766\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2012\/08\/PT-e1439583827971.png\" \/><\/em><\/strong><\/a><\/p>\n<p>On Thursday May 4, demonstrators gathered outside the Rio de Janeiro State Justice Tribunal to protest the conviction of <a href=\"http:\/\/bit.ly\/2qYHA5m\" target=\"_blank\" rel=\"noopener noreferrer\">Rafael Braga<\/a>, who on April 20 was <a href=\"http:\/\/bit.ly\/2q6vZmr\" target=\"_blank\" rel=\"noopener noreferrer\">sentenced to 11 years in prison for drug trafficking<\/a>. This was the latest development in a sequence of abusive treatment by police and other members of the Brazilian justice system that goes back to June of 2013 when Braga, a <a href=\"http:\/\/bit.ly\/2alCmJC\" target=\"_blank\" rel=\"noopener noreferrer\">black man who was homeless at the time, was falsely accused<\/a> of possessing explosive materials following a <a href=\"http:\/\/bit.ly\/1wkGqvL\" target=\"_blank\" rel=\"noopener noreferrer\">massive protest<\/a>\u00a0in downtown Rio.<\/p>\n<p>Braga, who had not participated in the protests, was arrested by police for carrying a bottle of Pinho Sol cleaning product, which was later determined to have little chance of being used as an explosive. Regardless, he was found guilty of carrying an \u201cexplosive or incendiary device, without authorization or in breach of legal or regulatory determination\u201d and sentenced to five years and 10 months in prison.<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/05\/Tribunal.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-36424 size-content\" title=\"Protest leaving Military Tribunal. Photo by Maur\u00edcio Campos Dos Santos.\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/05\/Tribunal-620x264.jpg\" alt=\"Protest leaving Military Tribunal\" width=\"620\" height=\"264\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/05\/Tribunal-620x264.jpg 620w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/05\/Tribunal-940x400.jpg 940w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/p>\n<p>With representation provided by the <a href=\"http:\/\/bit.ly\/2q6FTo1\" target=\"_blank\" rel=\"noopener noreferrer\">Institute for Human Rights Defenders<\/a>, his sentence was eventually reduced and in October of 2014 Rafael was allowed \u201csemi open\u201d privileges, which allowed him to begin work at a local law firm. However, after an image was posted on social media showing him next to a graffiti piece reading, \u201cYou only look from the left to the right, while the State crushes you from top to bottom,\u201d Braga\u2019s semi open status was revoked and he was placed in solitary confinement for one month. After being released with an electronic ankle monitor in December of 2015 the police approached him again while walking to a bakery near his home and this time accused him of drug trafficking. The officers are believed to have forced him to confess and fabricated his possession of cocaine and marijuana to verify their claim. It was on April 20 that Rafael Braga was sentenced to 11 years in prison, a decision\u00a0that his lawyers are planning to appeal.<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/05\/Amnesty.jpg\"><img decoding=\"async\" class=\"alignright wp-image-36420 size-medium\" title=\"Amnesty International banner: Rafael Braga we haven't forgotten you.\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/05\/Amnesty-300x300.jpg\" alt=\"Amnesty International banner: Rafael Braga we haven't forgotten you.\" width=\"300\" height=\"300\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/05\/Amnesty-300x300.jpg 300w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/05\/Amnesty-768x768.jpg 768w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/05\/Amnesty.jpg 800w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>Tensions were high last Thursday as protestors marched from the Justice Tribunal to the Lapa Arches chanting cheers such as \u201cit hasn\u2019t stopped, it has to stop, I want an end to the <a href=\"http:\/\/bit.ly\/1JS6zYI\" target=\"_blank\" rel=\"noopener noreferrer\">Military Police<\/a>,\u201d while heavily armored officers followed on the sidelines. Leaders of the <a href=\"http:\/\/bit.ly\/2r5alh1\" target=\"_blank\" rel=\"noopener noreferrer\">Movement to Free Rafael Braga<\/a>, who organized the event, condemned the actions of police over a loud speaker: \u201c<a href=\"http:\/\/bit.ly\/2pBdFOZ\" target=\"_blank\" rel=\"noopener noreferrer\">Rafael Braga<\/a>, he is a symbol, he and various others who are prisoners, who were\u00a0framed, who are innocent. How long will this continue? How long can we permit this?\u201d Brenner, a member of the movement, reaffirmed the group&#8217;s commitment to freeing Braga: \u201cWe will not allow more people to be imprisoned or killed. This is a national movement, an international movement for the freedom of Rafael Braga.\u201d<\/p>\n<p>The current flood of corruption charges in the Brazilian government as well as <a href=\"http:\/\/bit.ly\/2c7O0bB\" target=\"_blank\" rel=\"noopener noreferrer\">high rates of extrajudicial killing<\/a> in Rio over the last several years has eroded confidence in the integrity of security forces. \u201cSimply for the fact that he was collecting recyclable material, this is why he was arrested, this is why he was approached by the police, this is why they forged what happened,\u201d commented Jo\u00e3o, another member of the Movement to Free Rafael Braga and volunteer at the protest. He continued to explain the regularity of oppressive behavior by police: \u201cThe police <a href=\"http:\/\/bit.ly\/29tM7HQ\" target=\"_blank\" rel=\"noopener noreferrer\">kill black people every day<\/a>. The police of Rio de Janeiro <a href=\"http:\/\/bit.ly\/2pWNZxt\" target=\"_blank\" rel=\"noopener noreferrer\">kill more than anyone<\/a> in the world. They don\u2019t have the right to <a href=\"http:\/\/bit.ly\/2aylCjf\" target=\"_blank\" rel=\"noopener noreferrer\">terrorize the public<\/a>.\u201d<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/05\/Protest.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-36426 size-content\" title=\"Protest marching through city center. Photo by Maur\u00edcio Campos Dos Santos.\" width=\"620\" height=\"264\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/05\/Protest-620x264.jpg 620w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/05\/Protest-940x400.jpg 940w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/p>\n<p><a href=\"http:\/\/bit.ly\/2qjNH3c\" target=\"_blank\" rel=\"noopener noreferrer\">Residents of favelas are often those most affected<\/a>\u00a0by these oppressive actions especially\u00a0by the\u00a0<a href=\"http:\/\/bit.ly\/2q0AYFN\" target=\"_blank\" rel=\"noopener noreferrer\">Pacifying Police Units<\/a>. Laya, a member of a local education network, commented on this relationship: \u201cI am a black woman who lives in a community that is assaulted every day by\u00a0the Military Police here in Rio de Janeiro where we have the UPP who make our situation worse and confront us daily.\u201d<\/p>\n<p>While tensions were high with what appears to be a long struggle ahead, the protest served to show the resilience and solidarity of local residents who are committed to the pursuit of justice in their city. One women who came to the protest as a member of the <a href=\"http:\/\/bit.ly\/2poePC3\" target=\"_blank\" rel=\"noopener noreferrer\">United Black Movement<\/a> had this to say, \u201cWe Brazilians, black and white, who believe it is possible to transform these things, we will march in the streets until justice is done.&#8221;<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/05\/Lapa.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-36428 size-content\" title=\"Protest arrives at Lapa arches.
