{"id":36879,"date":"2017-06-14T12:33:35","date_gmt":"2017-06-14T15:33:35","guid":{"rendered":"http:\/\/www.rioonwatch.org\/?p=36879"},"modified":"2017-06-15T15:35:18","modified_gmt":"2017-06-15T18:35:18","slug":"brazils-new-law-on-land-regularization-a-step-forward-or-back","status":"publish","type":"post","link":"https:\/\/rioonwatch.org\/?p=36879","title":{"rendered":"Brazil&#8217;s New Law on Land Regularization: A Step Forward or Back?"},"content":{"rendered":"<p style=\"text-align: right;\"><a href=\"http:\/\/bit.ly\/2rtzd4c\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><em>Clique aqui para Portugu\u00eas<img decoding=\"async\" width=\"20\" height=\"20\" class=\"alignright size-full wp-image-23766\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2012\/08\/PT-e1439583827971.png\" \/><\/em><\/strong><\/a><\/p>\n<p>On Wednesday, May 31, the Brazilian Senate approved <a href=\"http:\/\/bit.ly\/2ooRyvF\" target=\"_blank\" rel=\"noopener noreferrer\">Provisional Measure 759\/2016<\/a> (MP 759), which deals with <a href=\"http:\/\/bit.ly\/1gTv41b\" target=\"_blank\" rel=\"noopener noreferrer\">land regularization<\/a> for <a href=\"http:\/\/bit.ly\/2kSEq2b\" target=\"_blank\" rel=\"noopener noreferrer\">rural, urban and Amazonian lands<\/a>. It\u00a0now\u00a0moves ahead for presidential approval. The measure faces\u00a0<a href=\"http:\/\/bit.ly\/2rL93eI\" target=\"_blank\" rel=\"noopener noreferrer\">harsh criticism from opposition in the Senate, mainly regarding the effect of the new legislation on rural areas<\/a>, with\u00a0claims that it will weaken small landholders and encourage the reconcentration of land and, at the very least, increase the rural exodus and pressure on urban areas. The MP, despite proposing innovations such as the <em><a href=\"http:\/\/bit.ly\/2kSEq2b\" target=\"_blank\" rel=\"noopener noreferrer\">direito a laje<\/a><\/em>\u00a0and the simplification of the processes of <a href=\"http:\/\/bit.ly\/1g5NTqt\">obtaining titles<\/a>, is being questioned by <a href=\"http:\/\/bit.ly\/1HtiSgi\" target=\"_blank\" rel=\"noopener noreferrer\">social movements<\/a>, who say\u00a0that in practice it will make low-income households more subject to <a href=\"http:\/\/bit.ly\/24URtjp\" target=\"_blank\" rel=\"noopener noreferrer\">real estate speculation<\/a>. A group of parliamentarians are now <a href=\"http:\/\/bit.ly\/2s09Ya5\" target=\"_blank\" rel=\"noopener noreferrer\">attempting to suspend the bill<\/a>.<\/p>\n<p>According to Rodrigo Numeriano, from the Ministry of Cities, the measure advances\u00a0existing legislation by extending the scope of the &#8220;urban area&#8221; category\u00a0to all those that exercise an urban function and launching\u00a0a policy of land regularization beyond the mere <a href=\"http:\/\/bit.ly\/1gTv41b\" target=\"_blank\" rel=\"noopener noreferrer\">concession of property titles<\/a>. The law&#8217;s main novelty\u00a0in terms of urban land regularization is the recognition of the so-called <em>direito a laje<\/em>, or\u00a0&#8220;<a href=\"http:\/\/bit.ly\/2kSEq2b\" target=\"_blank\" rel=\"noopener noreferrer\">slab rights<\/a>.&#8221; Property ownership in accordance with this provisional measure will no longer be linked to the land below; it\u00a0may also be linked to the <em><a href=\"http:\/\/bit.ly\/2lh0chd\" target=\"_blank\" rel=\"noopener noreferrer\">laje<\/a><\/em>, or consolidated rooftop\u00a0above. Thus, a property built on a <em>laje<\/em>\u00a0becomes an independent unit, subject to taxation. And beyond\u00a0the <i>laje<\/i>, any add-on the home, known as a\u00a0<em>puxadinho<\/em>,\u00a0can now be regularized as independent property, provided it has access to a public road.<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/06\/5-Horto-300x2241.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-content wp-image-36885\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/06\/5-Horto-300x2241-620x264.jpg\" alt=\"\" width=\"620\" height=\"264\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/06\/5-Horto-300x2241-620x264.jpg 620w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/06\/5-Horto-300x2241-940x400.jpg 940w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/p>\n<p>&#8220;It&#8217;s the bending of civil law to reality,&#8221; says Numeriano, stressing how laws sometimes distance themselves from people&#8217;s real experience. Still, he says some lawyers have been bothered by the inclusion of the word &#8220;<em>laje<\/em>&#8221; in a formal legal mechanism <a href=\"http:\/\/bit.ly\/1Wvrv0E\" target=\"_blank\" rel=\"noopener noreferrer\">because of its lack of &#8220;nobility<\/a>.&#8221; They proposed a <a href=\"http:\/\/bit.ly\/1h6Zk8a\" target=\"_blank\" rel=\"noopener noreferrer\">nomenclature<\/a> that they argued to be more appropriate: surface and overhead rights. This illustrates well the institutional <a href=\"http:\/\/bit.ly\/1IjFtt1\" target=\"_blank\" rel=\"noopener noreferrer\"> segregation<\/a>\u00a0and <a href=\"http:\/\/bit.ly\/1JVdggj\" target=\"_blank\" rel=\"noopener noreferrer\">stigmatization<\/a>, as well as the social and spatial segregation suffered by favela residents: a social reality, that can be <a href=\"http:\/\/bit.ly\/2oLs0ed\" target=\"_blank\" rel=\"noopener noreferrer\">theorized academically<\/a> and can be the object of regulation, does not have sufficient dignity to be integrated into the law. It is linked to\u00a0the <a href=\"http:\/\/bit.ly\/2alCmJC\" target=\"_blank\" rel=\"noopener noreferrer\">criminalization of poverty<\/a>.<\/p>\n<p>Another issue of nomenclature lies in the proposed change in the Provisional Measure to replace the old-fashioned term &#8220;informal settlements&#8221; with &#8220;consolidated informal urban nuclei.&#8221; This change, however, does not solve the essential problem of the term, contained in the term &#8220;informal,&#8221; which can be understood as denoting precariousness and transience, as if the favelas, in their diversity, did not have houses as formally built as any others, or weren&#8217;t as formal as any other part of the city.<\/p>\n<p>In addition to the <em>direito a laje<\/em>, land regularization for low-income families will be free, donation taxes will not be required\u00a0on land transferred from the federal government\u00a0for social use, the <a href=\"http:\/\/bit.ly\/1K8qZ3M\" target=\"_blank\" rel=\"noopener noreferrer\">adverse possession<\/a> registry will automatically be converted into an ownership registry\u00a0after the period defined in the law (five years for urban areas), and the notarial\u00a0process to obtain titles\u00a0will be simplified.<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/06\/abandonado2.jpg\"><img decoding=\"async\" class=\"aligncenter size-content wp-image-36887\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/06\/abandonado2-620x264.jpg\" alt=\"\" width=\"620\" height=\"264\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/06\/abandonado2-620x264.jpg 620w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/06\/abandonado2-940x400.jpg 940w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/p>\n<p>Another change may have an impact on social housing. Previously, when the government seized\u00a0an abandoned property, it had little incentive to carry out structural improvements on said property\u00a0and make it available\u00a0as social housing, because within a three-year window\u00a0the owner could go to court to reclaim it, along with the improvements that had been\u00a0made. The provisional measure proposes that the owner only gets to reclaim the property if he reimburses the government for\u00a0investments it has made in the property.<\/p>\n<p>&#8220;The issue of regularization and formalization is not the political priority of most residents. Rather, the provision of services, the guarantee of rights (is the priority),&#8221; argues Rafael Soares, Professor of Social Work at Rio&#8217;s Pontifical Catholic University (PUC-Rio). &#8220;Buying, selling and renting has always existed in favelas, regularized or not.&#8221; For him, as long as land regularization emerges as a one-time\u00a0program, and not a permanent and integrated policy, it will not produce good results.<\/p>\n<p>Andreia, a doctoral student in Social Work and <a href=\"http:\/\/bit.ly\/12onlyE\" target=\"_blank\" rel=\"noopener noreferrer\">Cantagalo<\/a> resident, sees land regularization as a threat. &#8220;In addition to raising living costs by collecting taxes, this means that if the person is unable to pay, the state will be able to come and take the person&#8217;s home. And it still paves the way for <a href=\"http:\/\/bit.ly\/2s4CTbf\" target=\"_blank\" rel=\"noopener noreferrer\">real estate speculation<\/a>, for <a href=\"http:\/\/bit.ly\/1l6Oo5g\" target=\"_blank\" rel=\"noopener noreferrer\">gentrification<\/a>,&#8221; she said. According to analysts, <a href=\"http:\/\/bit.ly\/1Kw6Y88\" target=\"_blank\" rel=\"noopener noreferrer\">public-private partnerships<\/a> will be facilitated by this provisional\u00a0measure and the regulation of high-end housing developments will be relaxed by the establishment\u00a0of distinct regulatory mechanisms for low- and high-income homeowners, which is dangerous because it subordinates public services to market logic and pardons the <a href=\"http:\/\/bit.ly\/2s4CTbf\" target=\"_blank\" rel=\"noopener noreferrer\">speculative real estate market<\/a>. &#8220;These areas still don&#8217;t have the socioeconomic conditions to dispute with market logic, a perverse logic within a neoliberal view that guarantees no rights. Families are going to suffer brutal capital pressure, they are less likely to maintain these lands,&#8221; says Maria L\u00facia Pontes, from the Land and Housing Nucleus (NUTH) of the <a href=\"http:\/\/bit.ly\/1tXvTWY\" target=\"_blank\" rel=\"noopener noreferrer\">Public Defenders&#8217; Office<\/a>\u00a0of the state of Rio de Janeiro.<\/p>\n<p>&#8220;To give out property titles transfers the state&#8217;s problem to the individual,&#8221; says Soares, arguing that private property cannot be seen as the grand\u00a0solution for land regularization. The causal relationship between periods of economic growth and real estate expansion and <a href=\"http:\/\/bit.ly\/1pO06YP\" target=\"_blank\" rel=\"noopener noreferrer\">evictions<\/a>, and between periods of recession and efforts toward regularization&#8211;which puts more land on the market and withdraws\u00a0certain responsibilities from the state&#8211;is clear. For Soares, the bet should be made on social rent, combined with the <a href=\"http:\/\/bit.ly\/1LnLRXK\" target=\"_blank\" rel=\"noopener noreferrer\">infrastructure<\/a> provision\u00a0(such as <a href=\"http:\/\/bit.ly\/1v0vXGK\" target=\"_blank\" rel=\"noopener noreferrer\">transportation<\/a>) and services (<a href=\"http:\/\/bit.ly\/1upL4KU\" target=\"_blank\" rel=\"noopener noreferrer\">sanitation<\/a>, <a href=\"http:\/\/bit.ly\/ZdoIRD\" target=\"_blank\" rel=\"noopener noreferrer\">security<\/a>, garbage collection, among others).<\/p>\n<p>Other criticisms of the provisional measure are in the weakening of Brazil&#8217;s pioneering\u00a0<a href=\"http:\/\/bit.ly\/1EkRliM\" target=\"_blank\" rel=\"noopener noreferrer\">Areas of Special Social Interest<\/a>, or AEIS legislation. The MP extinguishes\u00a0some of the criteria in this legislation that allowed favelas to be preferentially treated for upgrades by the government, while preserving qualities such as affordability. By\u00a0facilitating the\u00a0<a href=\"http:\/\/bit.ly\/24URtjp\" target=\"_blank\" rel=\"noopener noreferrer\">transfer of public lands to the private sector<\/a>, the legislation threatens\u00a0the fulfillment of land&#8217;s constitutionally-mandated\u00a0social function and specifically threatens favelas located on public lands. In addition, the legislation does\u00a0not contain the regulatory mechanisms for implementing that which it proposes. This lack of clarity leaves its propositions subject to future regulations, local laws and arbitrary actions by the government, weakening their application, different from previous legal mechanisms, which were self-applicable, meaning they contained in themselves all necessary regulation for their application.<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/06\/carta-brasil.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-36891 size-large\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2017\/06\/carta-brasil-1024x600.png\" alt=\"\" width=\"620\" height=\"363\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/06\/carta-brasil-1024x600.png 1024w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/06\/carta-brasil-300x176.png 300w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/06\/carta-brasil-768x450.png 768w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2017\/06\/carta-brasil.png 1029w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/p>\n<p>An <a href=\"http:\/\/bit.ly\/2sku8K0\" target=\"_blank\" rel=\"noopener noreferrer\">open letter against the provisional measure<\/a> signed by various social movements and public institutions, including the NUTH, denounces these\u00a0setbacks. It states that there is no urgency for the approval of this provisional measure due to the existence of previous laws governing housing and regularization,\u00a0and that its publication on December 22 was suspect. New legislation is needed, but it is preferable to maintain\u00a0<a href=\"http:\/\/bit.ly\/1OzrB24\" target=\"_blank\" rel=\"noopener noreferrer\">older laws\u00a0that have robust implementation guarantees<\/a> while change is discussed in a <a href=\"http:\/\/bit.ly\/1rkcjHD\" target=\"_blank\" rel=\"noopener noreferrer\">participatory and integrated process<\/a>.<\/p>\n<p>Other planned changes in the provisional measure can be found on the <a href=\"http:\/\/bit.ly\/2rL93eI\" target=\"_blank\" rel=\"noopener noreferrer\">Senate website<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>Clique aqui para Portugu\u00eas On Wednesday, May 31, the Brazilian Senate approved Provisional Measure 759\/2016 (MP 759), which deals with land regularization for rural, urban and Amazonian lands.
