{"id":37993,"date":"2017-08-09T12:34:22","date_gmt":"2017-08-09T15:34:22","guid":{"rendered":"http:\/\/www.rioonwatch.org\/?p=37993"},"modified":"2019-06-05T17:32:10","modified_gmt":"2019-06-05T20:32:10","slug":"institutional-racism-in-the-legal-system-and-the-rafael-braga-and-ogo-alves-cases","status":"publish","type":"post","link":"https:\/\/rioonwatch.org\/?p=37993","title":{"rendered":"Brazil: Institutional Racism in the Legal System and the Rafael Braga and Ogo Alves Cases"},"content":{"rendered":"<p style=\"text-align: right;\"><a href=\"http:\/\/bit.ly\/2vKUrht\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><em>Clique aqui para Portugu\u00eas<img decoding=\"async\" width=\"20\" height=\"20\" class=\"alignright size-full wp-image-23766\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2012\/08\/PT-e1439583827971.png\" alt=\"\" \/><\/em><\/strong><\/a><\/p>\n<p><a href=\"http:\/\/bit.ly\/2pBdFOZ\" target=\"_blank\" rel=\"noopener noreferrer\">Rafael Braga<\/a> was <a href=\"http:\/\/bit.ly\/2q6vZmr\" target=\"_blank\" rel=\"noopener noreferrer\">detained during the 2013 demonstrations for carrying a bottle of Pinho Sol disinfectant<\/a>, and again in early 2016, a month after being released to serve his sentence in freedom, for possession of drugs, which many claim were planted by police. The second time, <a href=\"http:\/\/bit.ly\/2qvQHxB\" target=\"_blank\" rel=\"noopener noreferrer\">he was sentenced<\/a> to 11 years for drug trafficking. <a href=\"http:\/\/bit.ly\/2vIV4aX\" target=\"_blank\" rel=\"noopener noreferrer\">Ogo Alves da Silva<\/a>, now of age, has been detained in a <a href=\"http:\/\/bit.ly\/1QHoVDK\" target=\"_blank\" rel=\"noopener noreferrer\">Degase<\/a> (<a href=\"http:\/\/bit.ly\/1OYRneN\" target=\"_blank\" rel=\"noopener noreferrer\">Rio de Janeiro Department of General Socio-Educational Action<\/a>) unit since 2015, accused of stabbing a medical doctor who had been cycling around the Rodrigo de Freitas Lagoon in Rio&#8217;s wealthy <a href=\"http:\/\/bit.ly\/2plEDyV\" target=\"_blank\" rel=\"noopener noreferrer\">South Zone<\/a>.<\/p>\n<p>Both have some things in common: they are young, black, and poor. Rafael was homeless. Ogo was a resident of the <a href=\"http:\/\/bit.ly\/1sksV07\" target=\"_blank\" rel=\"noopener noreferrer\">Manguinhos<\/a> favela in the <a href=\"http:\/\/bit.ly\/2vsoIkZ\" target=\"_blank\" rel=\"noopener noreferrer\">North Zone<\/a> of the city, which <a href=\"https:\/\/glo.bo\/2vdWFV0\" target=\"_blank\" rel=\"noopener noreferrer\">according to witnesses<\/a> is <a href=\"http:\/\/bit.ly\/2vIV4aX\" target=\"_blank\" rel=\"noopener noreferrer\">where he was when the crime happened<\/a>, more than 15km away from the Lagoon.<\/p>\n<p>But the police needed a suspect to calm things down after a crime that shocked everyone\u2013<em>a life for a bicycle<\/em>, a <em>doctor<\/em>, in the city\u2019s <em>South Zone<\/em>. So police officers went to Ogo\u2019s house in Manguinhos, who had a record for thefts in the <a href=\"http:\/\/bit.ly\/1L9XR8Q\" target=\"_blank\" rel=\"noopener noreferrer\">Lagoa<\/a> area. There not only did they find his mother, dona Jane, but they also found knives. Dona Jane is a waste picker, and the knives that served as proof against her son are <a href=\"http:\/\/bit.ly\/2vIV4aX\" target=\"_blank\" rel=\"noopener noreferrer\">her work implements<\/a>\u00a0when collecting and handling garbage.<\/p>\n<p><a href=\"http:\/\/rioonwatch.org.br\/wp-content\/uploads\/2017\/08\/Hogo1.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-27474 size-content\" title=\"Ogo is detained by the police. Photo: Fabio Rossi \/ Ag\u00eancia O Globo (20\/05\/2015).\" src=\"http:\/\/rioonwatch.org.br\/wp-content\/uploads\/2017\/08\/Hogo1-620x264.jpg\" alt=\"\" width=\"620\" height=\"264\" \/><\/a><\/p>\n<p>The only witness to the crime, a gas station worker, said at the time that there were two criminals, a white and a black man, but that <a href=\"https:\/\/glo.bo\/2fnqBbN\" target=\"_blank\" rel=\"noopener noreferrer\">he would be unable to recognize them because of how quickly the incident happened<\/a>. Two days later, when Ogo was arrested, however, he recognized him in a photo as the offender, in\u00a0<a href=\"https:\/\/glo.bo\/2fnqBbN\" target=\"_blank\" rel=\"noopener noreferrer\">a statement with several discrepancies<\/a> in relation to his former statement.<\/p>\n<p><img decoding=\"async\" class=\"alignright wp-image-27493 size-thumbnail\" title=\"Jane Maria, Ogo's mother.\" src=\"http:\/\/rioonwatch.org.br\/wp-content\/uploads\/2017\/08\/Jane-Maria-365x264.jpg\" alt=\"\" width=\"365\" height=\"264\" \/><\/p>\n<p>A few days later a second teenager, aged 15, <a href=\"https:\/\/glo.bo\/2vH493w\" target=\"_blank\" rel=\"noopener noreferrer\">and also black<\/a>, turned himself in claiming participation in the crime. Less than two weeks later, a\u00a0third\u00a0teenager turned himself in, claiming that he had committed the crime with the second detained teenager and <a href=\"https:\/\/glo.bo\/2uiJAqy\" target=\"_blank\" rel=\"noopener noreferrer\">clearing Ogo<\/a>.<\/p>\n<p>Rafael and Ogo remain in jail even in the absence of evidence condemning them\u2013or rather, in a selective use of evidence and testimonies. Ogo was convicted based on a\u00a0contradictory testimony and an alleged weapon found in his home, but was not acquitted even after being cleared by someone who confessed to the crime. Rafael was arrested with a small amount of drugs and <a href=\"http:\/\/bit.ly\/2vyw3z3\" target=\"_blank\" rel=\"noopener noreferrer\">based only on the testimony of the police officers themselves<\/a>, as is often the case for young black Brazilians. But the <a href=\"http:\/\/bit.ly\/2qaffsX\" target=\"_blank\" rel=\"noopener noreferrer\">differences between what characterizes non-criminal drug \u2018use\u2019 and drug \u2018trafficking\u2019 are not well defined in law<\/a>, leaving judges to decide in each case. And justice has a <a href=\"http:\/\/bit.ly\/2hCxfeO\" target=\"_blank\" rel=\"noopener noreferrer\">much greater probability of defining the act as trafficking when the subject is black<\/a> than when they are white, even when the quantities are the same. The Ogo and Rafael cases illustrate the worst aspect of our judicial system: its institutional racism and the <a href=\"http:\/\/bit.ly\/2alCmJC\" target=\"_blank\" rel=\"noopener noreferrer\">criminalization of poverty<\/a> that give sentences on the basis of color and social background, and give whites and blacks unequal access to legal means.<\/p>\n<p><a href=\"http:\/\/rioonwatch.org.br\/wp-content\/uploads\/2017\/08\/Protestos-Rafael-Braga.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-27494 size-content\" title=\"The Rafael Braga case has provoked debates and protests across Rio and all of Brazil\" src=\"http:\/\/rioonwatch.org.br\/wp-content\/uploads\/2017\/08\/Protestos-Rafael-Braga-620x264.jpg\" alt=\"The Rafael Braga case has provoked debates and protests across Rio and all of Brazil\" width=\"620\" height=\"264\" \/><\/a><\/p>\n<p>Rafael and Ogo have something else in common: both were tried yesterday, in Rio de Janeiro\u2019s Court of Justice. Rafael\u2019s <em>habeas corpus<\/em> petition was rejected once again yesterday and he will remain in jail until trial. In Ogo\u2019s last trial, one of the judges voted in favor of his acquittal, and so the case was retried. He will continue to serve his sentence in Degase.<\/p>\n<p>At Degase, Ogo\u2019s behavior <a href=\"http:\/\/bit.ly\/2vIV4aX\" target=\"_blank\" rel=\"noopener noreferrer\">has a very positive record<\/a> and he is already attending the high school, having arrived there at 5th grade level.
