{"id":49277,"date":"2018-12-03T17:27:43","date_gmt":"2018-12-03T20:27:43","guid":{"rendered":"http:\/\/www.rioonwatch.org\/?p=49277"},"modified":"2022-08-15T12:25:05","modified_gmt":"2022-08-15T15:25:05","slug":"favela-clt-workshops-part-2-legislative-workshop-debating-a-clt-law-in-brazil","status":"publish","type":"post","link":"https:\/\/rioonwatch.org\/?p=49277","title":{"rendered":"Favela CLT Workshops, Part 2: Legislative Workshop, Debating a CLT Law in Brazil"},"content":{"rendered":"<p style=\"text-align: right;\"><a href=\"http:\/\/bit.ly\/2A917pk\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\"><i>Clique aqui para Portugu\u00eas<\/i><\/span><span class=\"s2\"><i><span class=\"Apple-converted-space\"><em><img decoding=\"async\" class=\"alignright size-full wp-image-23766\" src=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2012\/08\/PT-e1439583827971.png\" width=\"20\" height=\"20\" \/><\/em><\/span><\/i><\/span><\/a><\/p>\n<p><em>In Rio de Janeiro, from August 23 to 27, 2018,\u00a0<a href=\"http:\/\/bit.ly\/ZsEul3\" target=\"_blank\" rel=\"noopener noreferrer\">Catalytic Communities<\/a>* (CatComm) organized a\u00a0<a href=\"http:\/\/bit.ly\/CanoRioCLTs\" target=\"_blank\" rel=\"noopener noreferrer\">series of workshops<\/a>\u00a0on\u00a0<a href=\"http:\/\/bit.ly\/2P1UJGJ\" target=\"_blank\" rel=\"noopener noreferrer\">Community Land Trusts<\/a>\u00a0(CLTs), together with a special delegation from the\u00a0<a href=\"http:\/\/bit.ly\/2qmibl8\" target=\"_blank\" rel=\"noopener noreferrer\">Ca\u00f1o Mart\u00edn Pe\u00f1a CLT based in San Juan, Puerto Rico<\/a>.\u00a0The workshops were designed to discuss this urban planning tool and consider its\u00a0<a href=\"http:\/\/bit.ly\/2K6gfqb\" target=\"_blank\" rel=\"noopener noreferrer\">potential applicability in Brazilian favelas<\/a>. Over the five days of workshops, 130 individuals participated, including fifty community leaders and residents of Rio\u2019s favelas.\u00a0The workshops were organized in partnership with the Rio de Janeiro State Public Defender\u2019s Office, the Pastoral de Favelas, the Rio de Janeiro Architecture and Urbanism Council (CAU), the Laboratory for Studies of Transformations in Brazilian Urban Law (LEDUB), the Lincoln Institute of Land Policy (LILP), and the Global Land Alliance.<\/em><\/p>\n<p><em>The <a href=\"http:\/\/bit.ly\/2B22KXe\" target=\"_blank\" rel=\"noopener noreferrer\">first event was the Community Workshop<\/a>, which took place on August 23 at the\u00a0<a href=\"http:\/\/bit.ly\/2Msia9M\" target=\"_blank\" rel=\"noopener noreferrer\">Rio Public Defender\u2019s Office Foundation School<\/a>\u00a0(FESUDEPERJ), specifically featuring residents and community leaders from favelas in Rio and community leaders from favelas in Puerto Rico. On August 24, at the same venue, the Legislative Workshop (reported on below) was held for technical advisors and members of civil society\u2014lawyers, housing movements, non-governmental support organizations, architects, engineers, and urban planners\u2014interested in discussing the legal possibilities for applying the\u00a0<a href=\"http:\/\/bit.ly\/1HkVjJd\" target=\"_blank\" rel=\"noopener noreferrer\">CLT<\/a>\u00a0model in Brazil. On August 25 and 26, local community workshops were hosted in favelas in collaboration with residents\u2014the first in\u00a0<a href=\"http:\/\/bit.ly\/2hEA3Je\" target=\"_blank\" rel=\"noopener noreferrer\">Barrinha<\/a>\u00a0and the second in\u00a0<a href=\"http:\/\/bit.ly\/2CY1E0n\" target=\"_blank\" rel=\"noopener noreferrer\">Vidigal<\/a>. On August 27, a morning gathering was held to present the CLT model to Brazilian authorities, as well as representatives of public agencies and political parties. In the afternoon, the Puerto Rican delegation presented their final conclusions to the general public at the headquarters of the\u00a0<a href=\"http:\/\/bit.ly\/2xEeEDK\" target=\"_blank\" rel=\"noopener noreferrer\">Rio de Janeiro Architecture and Urbanism Council<\/a>\u00a0(CAU).<br \/>\n<\/em><\/p>\n<hr \/>\n<p><span style=\"font-weight: 400;\">On August 24, the<\/span><span style=\"font-weight: 400;\">\u00a0second\u00a0workshop\u00a0on <a href=\"http:\/\/bit.ly\/2P1UJGJ\" target=\"_blank\" rel=\"noopener noreferrer\">Community Land Trusts<\/a>\u00a0(CLTs) took place. In attendance were 43 technical allies\u2014lawyers, representatives of housing movements and favela NGOs, architects, engineers, and urban planners\u2014interested in discussing the legal possibilities of applying the\u00a0<\/span><a href=\"http:\/\/bit.ly\/1HkVjJd\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">CLT model<\/span><\/a>\u00a0<span style=\"font-weight: 400;\">in Rio de Janeiro and the potential for Brazilian legislation to support and encourage the creation of CLTs in the country.<\/span><\/p>\n<p>Held at the <a href=\"http:\/\/bit.ly\/2Msia9M\" target=\"_blank\" rel=\"noopener noreferrer\">Rio Public Defender\u2019s Office Foundation School<\/a> (FESUDEPERJ), this workshop aimed to present the case study of the\u00a0<a href=\"http:\/\/bit.ly\/2qmibl8\" target=\"_blank\" rel=\"noopener noreferrer\">Ca\u00f1o Mart\u00edn Pe\u00f1a<\/a>\u00a0CLT in detail, with a focus on the law passed in Puerto Rico to establish the CLT. The exchange began with <a href=\"http:\/\/bit.ly\/2B22KXe\" target=\"_blank\" rel=\"noopener noreferrer\">a review of the previous day\u2019s presentations<\/a> and initial impressions of the CLT from community leaders.<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2018\/11\/Theresa-Williamson-CLT-Day-2.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-49278 size-content\" title=\"Theresa Williamson begins the workshop\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2018\/11\/Theresa-Williamson-CLT-Day-2-620x264.jpg\" alt=\"\" width=\"620\" height=\"264\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Theresa-Williamson-CLT-Day-2-620x264.jpg 620w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Theresa-Williamson-CLT-Day-2-940x400.jpg 940w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">During the morning session, community leaders Edivalma \u201cDi\u201d Sousa from the community of\u00a0<\/span><a href=\"http:\/\/bit.ly\/2mUO3xC\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">R\u00e1dio Sonda<\/span><\/a><span style=\"font-weight: 400;\">, Marcello Cl\u00e1udio Nunes Deodoro from\u00a0<\/span><a href=\"http:\/\/bit.ly\/1DeXIyq\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Indiana<\/span><\/a><span style=\"font-weight: 400;\">, and Giovana Berti from\u00a0<\/span><a href=\"http:\/\/bit.ly\/2x9MT4d\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Caet\u00e9s<\/span><\/a><span style=\"font-weight: 400;\">\u00a0initiated the workshop. They presented their initial impressions of the CLT model based on their experiences at the Community Workshop held the previous day. The three expressed their interest in the instrument as a potential means to fight eviction and gentrification, and to increase participation and community unity. They also expressed curiosity about how this <a href=\"http:\/\/bit.ly\/2OlbwY8\" target=\"_blank\" rel=\"noopener noreferrer\">tool could be applied<\/a>\u00a0to favelas in Rio. During the Community Workshop held the previous day, Deodoro had invited all those present to return to their respective communities and discuss the idea with friends and neighbors. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After the initial presentations by community leaders and welcoming of others in attendance,\u00a0<a href=\"http:\/\/bit.ly\/14isKbz\" target=\"_blank\" rel=\"noopener noreferrer\">Theresa Williamson<\/a>, executive\u00a0director of Catalytic Communities (CatComm), presented a succinct history of the CLT model and its emergence during the 1960s Civil Rights Movement in the United States. Williamson explained <a href=\"http:\/\/bit.ly\/2OpgfVL\" target=\"_blank\" rel=\"noopener noreferrer\">why the CLT model should be considered<\/a> for Rio de Janeiro\u2019s favelas, mentioning the importance of the example set by the Ca\u00f1o in expanding the tool to favelas.<\/span><\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-CLT-Day-2.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-49281 size-large\" title=\"The Puerto Rican team members share their experiences. Photo: Line Algoed\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-CLT-Day-2-1024x576.jpg\" alt=\"\" width=\"620\" height=\"349\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-CLT-Day-2-1024x576.jpg 1024w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-CLT-Day-2-300x169.jpg 300w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-CLT-Day-2-768x432.jpg 768w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-CLT-Day-2-580x326.jpg 580w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-CLT-Day-2-174x98.jpg 174w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-CLT-Day-2.jpg 2000w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">Later, participants heard from Mario N\u00fa\u00f1ez, Evelyn Qui\u00f1ones, Lyvia Rodr\u00edguez, and Alejandro Cott\u00e9, representing the institutions that are involved in the CLT in Puerto Rico\u2014the\u00a0<a href=\"http:\/\/bit.ly\/2CznhQY\" target=\"_blank\" rel=\"noopener noreferrer\">Ca\u00f1o Mart\u00edn Pe\u00f1a CLT<\/a>;\u00a0<\/span><span style=\"font-weight: 400;\">the <a href=\"http:\/\/bit.ly\/2OB4v20\" target=\"_blank\" rel=\"noopener noreferrer\">Group of Eight Communities<\/a> (<\/span><span style=\"font-weight: 400;\">G-8)<\/span><span style=\"font-weight: 400;\">\u00a0where the CLT is located; and the\u00a0<\/span><a href=\"http:\/\/bit.ly\/2NFD75R\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">ENLACE Project<\/span><\/a><span style=\"font-weight: 400;\">, a public agency charged with undertaking community planning and upgrading in the communities contemplated by the CLT. The four gave detailed presentations about the history of the <a href=\"http:\/\/www.rioonwatch.org\/?p=36081\" target=\"_blank\" rel=\"noopener noreferrer\">Ca\u00f1o Mart\u00edn Pe\u00f1a CLT<\/a> and the role of city authorities and technical allies. Urban planner Lyvia Rodriguez and social worker Alejandro Cott\u00e9\u2014both from the ENLACE Project\u2014spoke of the long strategic planning process carried out by residents through hundreds of meetings. It was through this process that the communities determined that a CLT would be the best land tenure security instrument for them. However, worldwide, there were no existing, well-known cases of CLTs in informal settlements, so they had to create one from scratch. Since there was no legal precedent for creating a CLT in Puerto Rico, they realized they would need to pass a law, which not only established the CLT but also created the ENLACE Project\u2014guaranteeing the implementation of the Ca\u00f1o Mart\u00edn Pe\u00f1a strategic development plan.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the case of the Ca\u00f1o Mart\u00edn Pe\u00f1a\u2014which encompasses eight settlements on the banks of the Mart\u00edn Pe\u00f1a Canal in San Juan, Puerto Rico\u2014settlements that had existed for over 80 years were threatened by infrastructure works to dredge the polluted canal. Having previously experienced evictions under the pretext that their homes were in an area of risk only to see luxury real estate developments take their place, residents were skeptical that the ultimate goal of public officials was actually to see them leave their land. They thus worked together with these technical allies to assess their options and ultimately decided to develop legislation that would allow for the creation of the Ca\u00f1o Mart\u00edn Pe\u00f1a CLT.<\/span><\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-2-CLT-Day-2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-49280 size-large\" title=\"Photo: Line Algoed\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-2-CLT-Day-2-1024x576.jpg\" alt=\"\" width=\"620\" height=\"349\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-2-CLT-Day-2-1024x576.jpg 1024w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-2-CLT-Day-2-300x169.jpg 300w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-2-CLT-Day-2-768x432.jpg 768w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-2-CLT-Day-2-580x326.jpg 580w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-2-CLT-Day-2-174x98.jpg 174w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2018\/11\/Puerto-Rican-Delegation-2-CLT-Day-2.jpg 2000w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">The CLT\u2014whose governing board is voted in by residents and managed by a majority of residents along with an active group of technical allies\u2014became the owner and permanent administrator of the land. The houses built on the land, however, belong to the families that live there\u2014who own both the structures and surface rights. As such, they can buy, sell, mortgage, and inherit their houses. In removing land value from the equation, and with a rule requiring that the sale of the house is always offered first to the CLT at an affordable rate, affordable housing in the community is guaranteed in perpetuity. Moreover, as collective landowners, residents have great bargaining power and influence over public policies that affect them since they are not negotiating individually but collectively, with a large body of allied technical experts working on their behalf. Through the CLT, residents have managed to remain in their neighborhoods, where they are able to collectively organize and work on <a href=\"http:\/\/bit.ly\/2M4cHGq\" target=\"_blank\" rel=\"noopener noreferrer\">community development<\/a> projects.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">During the afternoon session, Rio de Janeiro lawyer and urban planner\u00a0<a href=\"http:\/\/bit.ly\/2PtIuWR\" target=\"_blank\" rel=\"noopener noreferrer\">Tarcyla Fidalgo<\/a>\u00a0delivered a presentation on the <a href=\"http:\/\/bit.ly\/CLTs4Favelas\" target=\"_blank\" rel=\"noopener noreferrer\">potential to create a CLT in Brazil<\/a>\u00a0through existing land rights legislation, comparing Brazil&#8217;s options to those available in Puerto Rico. While the Puerto Rican communities had to press for the creation of a specific law that allowed for the creation of the CLT, existing Brazilian land law is quite comprehensive. Fidalgo explained that it is possible to move forward without the need for a new law. A CLT can even be created in a community that acquires the land through existing mechanisms, such as <a href=\"http:\/\/bit.ly\/2vxldbe\" target=\"_blank\" rel=\"noopener noreferrer\">collective adverse possession<\/a>. This is possible if, upon receiving their titles, residents decide to combine them and separate the land from surface rights, thus creating a CLT themselves. However, Fidalgo and the vast majority of those present recognized that a specific law to stimulate and recognize the CLT instrument in Brazil on a national (or at least municipal) level would be of great interest.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The late afternoon discussion welcomed debate from a highly technical audience, including representatives from the Land and Cartography Institute of the State of Rio de Janeiro (ITERJ), the Land and Housing Nucleus (NUTH) of the Public Defender&#8217;s Office of Rio de Janeiro, the Catholic Church&#8217;s favela support wing or <em>Pastoral de Favelas<\/em>, as well as representatives from the Metropolis Observatory, the City of Rio de Janeiro, the Graduate Program in Architecture and Urbanism at the Federal University of Rio de Janeiro (PROURB\u2013UFRJ), the Brazilian Support Service for Small and Micro Businesses (SEBRAE), the Brazilian Institute of Architects (IAB), the Court of Justice, the Nucleus of Housing and Urban Studies and Projects at the Fluminense Federal University (NEPHU\u2013UFF), the Favelas Observatory, the Urban and Regional Research and Planning Institute (IPPUR) at the Federal University of Rio de Janeiro (UFRJ), the State University of Rio de Janeiro (UERJ), the Pontifical Catholic University (PUC\u2013Rio), the Laboratory for Studies of Transformations in Brazilian Urban Law (LEDUB), and other local institutions.<\/span><\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2018\/11\/Participants-CLT-Day-2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-49279 size-large\" title=\"Participants ask technical questions during the CLT Legislative Workshop. The technical experts involved in the case of the Ca\u00f1o Mart\u00edn Pe\u00f1a made it very clear that <a href=\"http:\/\/bit.ly\/1rkcjHD\" target=\"_blank\" rel=\"noopener noreferrer\">community control<\/a> over actions is fundamental in creating and maintaining a CLT\u2014a point of agreement among the experts in attendance. It was emphasized that the Puerto Rican communities spent several years learning and creating social projects in preparation for <span style=\"color: #333333;\">implementing the CLT. Any CLT project in Brazil would also need to follow this model of education and<\/span> participation in formulating a collective plan for the community, whereby residents themselves arrive at the conclusion that the CLT is the best path towards achieving their goals. A representative of <a href=\"http:\/\/bit.ly\/2gIRRNw\" target=\"_blank\" rel=\"noopener noreferrer\">ITERJ<\/a> observed that this form of project management would be new and revolutionary given that we are in a place where politicians and governments tend to\u00a0<a href=\"http:\/\/bit.ly\/1rkcjHD\" target=\"_blank\" rel=\"noopener noreferrer\">impose projects upon communities through a top-down approach<\/a>\u2014a method widely known not only to be ineffective, but which often brings with it the additional and further complicating effect of dismantling communities&#8217; positive characteristics in the process.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The technicians and specialists present discussed the idea of the CLT and continued to ask the Puerto Rican delegation about their specific case. They were asked about procedures for buying and selling homes within the CLT, the composition of the CLT&#8217;s executive board, and whether or not the CLT has the right to build low-income housing within its domain. Finally, the day ended with the formation of a working group that will meet regularly to develop the idea of establishing a CLT in Rio de Janeiro&#8217;s favelas.
