This is the third article in a <a href=\"http:\/\/bit.ly\/2Ptqack\" target=\"_blank\" rel=\"noopener noreferrer\">five-part series<\/a>.<\/em><\/p>\n<p><strong><em>The position held by Brazilian authorities [of &#8220;acts of resistance killings,&#8221; or police killings of civilians claimed to take place in self defense] sends a message of guaranteed impunity for police that kill. Rio de Janeiro&#8217;s violent death rate\u2014which includes deaths due to police intervention\u2014is up to nine times higher among black children and adolescents.<\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">The far-right came to power in 2019, and the first months of the year already showed that this year, and likely the next few, will not be easy for those who live and survive in Brazilian favelas and peripheries. Let&#8217;s remember: Jair Bolsonaro won the presidential election with his \u201c<a href=\"http:\/\/bit.ly\/35S8GzP\" target=\"_blank\" rel=\"noopener noreferrer\">finger guns<\/a>,\u201d and, in Rio de Janeiro, current governor <a href=\"http:\/\/bit.ly\/2Y57Azm\" target=\"_blank\" rel=\"noopener noreferrer\">Wilson Witzel<\/a>, even before being elected, had already assumed openly racist, <a href=\"http:\/\/bit.ly\/30m69uv\" target=\"_blank\" rel=\"noopener noreferrer\">pro-militarization<\/a>, and elitist positions. It is no coincidence that, between January and April alone, Rio had the highest number of cases of a<\/span><i><span style=\"font-weight: 400;\">uto de resist\u00eancia <\/span><\/i><span style=\"font-weight: 400;\">(acts of resistance: a Brazilian legal designation for an event in which someone is killed in confrontation with the police, indicating the police acted in self-defense) in the last 20 years: <a href=\"http:\/\/bit.ly\/2qALF4a\" target=\"_blank\" rel=\"noopener noreferrer\">more than 400<\/a>.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One semester was enough to dispel any shadow of doubt between the obvious association of gestures, speeches, and practices of these authorities and the deepening of the black genocide, the militarization of daily life, and, consequently, the strengthening of a police force that kills at will (though only in certain areas).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Children and teens from the favelas, like those in any part of any Brazilian city, should have a <a href=\"http:\/\/bit.ly\/2kF8XTF\" target=\"_blank\" rel=\"noopener noreferrer\">right to their childhood<\/a>: to study, to play in the street, to buy candy, to play soccer, and to fly kites. Yet, judging by the deliberate permission of the irresponsible use of force in these territories or by the government\u2019s historic passivity in the face of violence against these young citizens in formation, past and current politicians must believe that black children and teens living in peripheries can be killed. As though their dreams and those of their families did not die along with them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><a href=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2019\/09\/MareChildKite.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-content wp-image-55559\" src=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2019\/09\/MareChildKite-620x264.jpg\" alt=\"\" width=\"620\" height=\"264\" \/><\/a><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Data from the 2018 <a href=\"http:\/\/www.mprj.mp.br\/documents\/20184\/540394\/DossieCriancaAdolescente2018.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Child and Adolescent Dossier<\/a> of the Institute for Public Security (<a href=\"http:\/\/bit.ly\/2qLLcfA\" target=\"_blank\" rel=\"noopener noreferrer\">ISP<\/a>), indicate that in 2017, 635 children and teens were murdered in the state of Rio. The data were calculated by cross-referencing <a href=\"http:\/\/bit.ly\/2lcYfV1\" target=\"_blank\" rel=\"noopener noreferrer\">Civil Police<\/a> and health institution records. The context is particularly pronounced among adolescents: more than one quarter (28.6%) of these deaths are homicides resulting from police intervention. Between 2007 and 2017, the murder rate in this age group increased by 68%.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Also according to the dossier, violent deaths (involving homicide, homicide as a result of police intervention, personal injury followed by death, and robbery followed by death) mainly affects Afro-Brazilians. In Rio de Janeiro, the rate of \u201cblack children and teens is 45.3 victims per 100,000 black residents from 0 to 17 years old, almost nine times higher than the rate among white children and teens, 5.1 victims,\u201d shows the document. \u201cConcerning the victims\u2019 profiles, they are predominantly male (\u2026) 95% (167 victims) of homicides resulting from police intervention and 89% (403 victims) of homicide victims were male,\u201d the dossier reveals.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of the cases that <a href=\"http:\/\/bit.ly\/2N0Har2\" target=\"_blank\" rel=\"noopener noreferrer\">gained international attention<\/a> was that of the boy Maicon, which occurred over 20 years ago in Rio. Maicon was two years old when he was murdered by police in the <a href=\"http:\/\/bit.ly\/2XW8L4i\" target=\"_blank\" rel=\"noopener noreferrer\">Acari<\/a> favela, in the city\u2019s <a href=\"http:\/\/bit.ly\/2IgR5qe\" target=\"_blank\" rel=\"noopener noreferrer\">North Zone<\/a>. Jose Luiz Farias da Silva, Maicon&#8217;s father, has been denouncing the death of his son for 23 years, seeking answers to the crime. \u201cThe case got registered as an <\/span><i><span style=\"font-weight: 400;\">auto de resist\u00eancia<\/span><\/i><span style=\"font-weight: 400;\">. I became an activist after that. April 15 marked 23 years [since my son was killed], an absurd case not only for Rio but for the whole country: a child became known as a criminal at the age of two. Brazil violated my right to answers about the case. More than that, they violated the right to life of my son,\u201d says Silva. What is most surprising is that Maicon\u2019s case expired and was archived, showing an incapability or lack of commitment to the investigations.<\/span><\/p>\n<p><em><a href=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2019\/10\/autoderesistencia2.jpeg\"><img decoding=\"async\" class=\"aligncenter wp-image-56436 \" title=\"Jos\u00e9 Luiz Faria da Silva, father of Maicon, victim of an auto de resist\u00eancia case that gained international attention. Photo: Ag\u00eancia Brasil\u00a0\" src=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2019\/10\/autoderesistencia2.jpeg\" alt=\"\" width=\"620\" height=\"427\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2019\/10\/autoderesistencia2.jpeg 754w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2019\/10\/autoderesistencia2-300x207.jpeg 300w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/em><\/p>\n<p><span style=\"font-weight: 400;\">Nat\u00e1lia Damazio, who worked as a lawyer and researcher for the Rio-based NGO <a href=\"http:\/\/bit.ly\/2N2lbjx\" target=\"_blank\" rel=\"noopener noreferrer\">Global Justice<\/a>, began working on litigation through the Inter-American Commission on Human Rights from 2014 to 2015. \u201cIn relation to the murder of Maicon, there was a shootout happening in Acari. That\u2019s why it was filed as an <\/span><i><span style=\"font-weight: 400;\">auto de resist\u00eancia<\/span><\/i><span style=\"font-weight: 400;\">. It was archived due to lack of evidence. Once a case is archived, only the presence of new evidence can re-open it,\u201d she explains.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The lawyer affirms that, after much difficulty, on the day of the case\u2019s expiration, a meeting took place with the Rio de Janeiro Public Prosecutor\u2019s Office. According to Damazio, the Public Prosecutor\u2019s office was more interested in archiving the case than answering the question of what could be done. Now, the case is only monitored internationally.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe are talking about a 20-year-long case. It should never have lasted 20 years. There were clear testimonials. One of the officers even confessed that he fired a shot, but it wasn\u2019t carried forward. It&#8217;s scary because there was a decree at the time [under then-Governor <a href=\"http:\/\/bit.ly\/2p62cwp\" target=\"_blank\" rel=\"noopener noreferrer\">Marcello Alencar<\/a>] called <\/span><i><span style=\"font-weight: 400;\">gratifica\u00e7\u00e3o faroeste<\/span><\/i><span style=\"font-weight: 400;\"> (the <a href=\"http:\/\/bit.ly\/2o9ovRB\" target=\"_blank\" rel=\"noopener noreferrer\">Wild West Bonus<\/a>). In this case, they [the police] received a financial reward for \u2018success in this operation,\u2019\u201d added Damazio.\u00a0<\/span><\/p>\n<h3><b>Authorities Send a Message of Guaranteed Impunity<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Like Maicon&#8217;s, countless other Brazilian children and adolescents suffer violent deaths daily. \u201cThere are several cases of children, babies murdered by the police and it&#8217;s very serious. Can you imagine what would happen in this country, in this state, if the Rio de Janeiro <a href=\"http:\/\/bit.ly\/2WQxnqh\" target=\"_blank\" rel=\"noopener noreferrer\">Military Police<\/a> killed a ten-year-old boy leaving school in <a href=\"http:\/\/bit.ly\/2p61G1r\" target=\"_blank\" rel=\"noopener noreferrer\">Leblon<\/a> [a wealthy neighborhood in Rio]? The city would stop, the country would stop, the Security Secretary would lose his job, the governor would follow, even the president. But no. Since they are black children in the favelas, you get this whole imaginary that part of the society carries with them, deeming them \u2018seeds of evil\u2019 or something similar,\u201d affirms Lucas Pedretti, a historian who researches State violence in Brazil\u2019s dictatorship and democracy.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For Pedretti, it\u2019s as if it doesn\u2019t matter what the person did. The fact of being a black person, of living in a favela, is enough to not only cause mistrust, but for people to call the person a criminal. \u201cWhen this happens with a child, it is even more serious. It\u2019s the idea that because the child is black, because he lives in the favela, that the child will become a criminal. So this execution, this murder, is seen as natural by a significant part of society, which allows this to keep happening. The fact is that no one deserves such treatment,\u201d adds Pedretti.\u00a0<\/span><\/p>\n<p><em><a href=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2019\/10\/autosderesistencia3.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-56435 \" title=\"Youth at the &quot;Stop Killing Us&quot; protest in May 2019. Photo: Daiana Contini\" src=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2019\/10\/autosderesistencia3-1024x768.jpg\" alt=\"\" width=\"620\" height=\"465\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2019\/10\/autosderesistencia3-1024x768.jpg 1024w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2019\/10\/autosderesistencia3-300x225.jpg 300w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2019\/10\/autosderesistencia3-768x576.jpg 768w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2019\/10\/autosderesistencia3-174x131.jpg 174w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2019\/10\/autosderesistencia3-70x53.jpg 70w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2019\/10\/autosderesistencia3-326x245.jpg 326w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2019\/10\/autosderesistencia3.jpg 2048w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/em><\/p>\n<p><span style=\"font-weight: 400;\">A number of issues keep cases like Maicon\u2019s from being investigated, among them police corporatism and the <a href=\"http:\/\/bit.ly\/2MwFN6z\" target=\"_blank\" rel=\"noopener noreferrer\">criminalization of poverty<\/a>. Such factors transform homicides into \u201ccollateral damage\u201d or \u201cstray bullets.\u201d \u201cWe have a serious problem in terms of forensics. It&#8217;s done by the Civil Police, without exception. We need independent forensics. The second point is that when an event is registered as an <\/span><i><span style=\"font-weight: 400;\">auto de resist\u00eancia<\/span><\/i><span style=\"font-weight: 400;\">, in the moment of the denunciation, the analysis accepts that the event occurred as such. But it is not punishable, because there is the idea that the person (the police officer) was not to blame. This occurs because cases such as these take place in the favelas. Who fired the shot isn\u2019t investigated; the victim is investigated\u201d observes Damazio.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There is also a lack of investigation for <\/span><i><span style=\"font-weight: 400;\">auto de resist\u00eancia <\/span><\/i><span style=\"font-weight: 400;\">cases. Historian Lucas Pedretti remembers that without judgment from case to case, everyone ends up blameless, resulting in de facto permission to kill. \u201cThere exists a legitimization from public authorities as well, because of the lack of interest in investigations. This increase in <\/span><i><span style=\"font-weight: 400;\">auto de resist\u00eancia <\/span><\/i><span style=\"font-weight: 400;\">cases is serious. Unfortunately, we can\u2019t say we\u2019re surprised. This is to be expected when you have a governor that says [the police] will \u2018<a href=\"http:\/\/bit.ly\/2ExITlK\" target=\"_blank\" rel=\"noopener noreferrer\">aim at their little heads<\/a>,&#8217;\u201d he criticizes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this way this genocide is a process organized by the official powers themselves: the governments verbalize and give orders, and the police acts without investigating. These are mechanisms, instruments\u2014including legal instruments\u2014that permit the reproduction of this model and guarantee impunity for the police officer who kills, who executes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2017, during the government of former president Michel Temer, the judgment of murders committed by the military against civilians was <a href=\"https:\/\/on.wsj.com\/2N2mBun\" target=\"_blank\" rel=\"noopener noreferrer\">transferred back from civil to military courts<\/a>. If the number of cases that were effectively investigated, judged, and sentenced in the civil courts was already low, this transfer may have provided an even greater stimulus for impunity.
