The series\u00a0is part of our\u00a0<a class=\"c-link\" href=\"https:\/\/bit.ly\/2QyzleH\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"slack-kit-tooltip\"><em>partnership with<\/em>\u00a0<em>The Rio Times<\/em><\/a><em>.\u00a0For the report as published in The Rio Times click\u00a0<a href=\"https:\/\/bit.ly\/30dPHP7\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>.<\/em><\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">As the new coronavirus has swept Brazil, its <\/span><a href=\"https:\/\/bit.ly\/CoronavirusNasFavelas\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">danger<\/span><\/a><span style=\"font-weight: 400;\"> to the favela population has been well documented. Adding to this, Rio de Janeiro&#8217;s favelas experienced <\/span><a href=\"https:\/\/bit.ly\/3dbvPA8\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">new spikes<\/span><\/a><span style=\"font-weight: 400;\"> in a long history of police violence in April and May, and residents responded with new mobilizations. As part of the global Black Lives Matter movement, Brazilians <a href=\"https:\/\/glo.bo\/30GCvl1\" target=\"_blank\" rel=\"noopener noreferrer\">across the country<\/a>, including many <a href=\"https:\/\/bit.ly\/2MNdrlL\" target=\"_blank\" rel=\"noopener noreferrer\">favela activists<\/a>, took to the streets to <\/span><span style=\"font-weight: 400;\">protest<\/span><span style=\"font-weight: 400;\"> against structural racism and police violence.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Against this backdrop, an <\/span><a href=\"https:\/\/bit.ly\/3eP028u\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">ongoing legal challenge<\/span><\/a><span style=\"font-weight: 400;\"> against police violence in Rio\u2019s favelas produced a number of critical decisions in Brazil\u2019s Supreme Court (STF). These decisions not only saved lives in recent weeks, according to researchers, but they also create an opening to set powerful precedent for courts\u2019 ability to check the actions of <\/span><a href=\"https:\/\/bit.ly\/3cRucaR\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Brazil\u2019s most lethal police force<\/span><\/a><span style=\"font-weight: 400;\">. The lawsuit is known as the ADPF das Favelas, and representatives of the coalition behind it discussed their efforts at a June 25 <\/span><a href=\"https:\/\/bit.ly\/2CAcH1S\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">online panel<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Rio de Janeiro public defender L\u00edvia Casseres described the lawsuit and citizen mobilization behind it as important correctives to a judicial system that would be better described as a \u201csystem of injustice\u201d toward favela residents.\u00a0<\/span><\/p>\n<h3>An Upward Trend of Police Killings<\/h3>\n<p><span style=\"font-weight: 400;\">Yearly official totals of killings by police and other government officers in the state of Rio have been on a general upward trend since 2013, when an effort at police reform in the state began to fray. At that time, police were responsible for <\/span><a href=\"https:\/\/bit.ly\/32FyU9q\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">around 13%<\/span><\/a><span style=\"font-weight: 400;\"> of the state\u2019s homicides. In 2017, police killed more than 1,000 people for the first time since 2009, and during a federal <a href=\"http:\/\/bit.ly\/1jQ1DtQ\" target=\"_blank\" rel=\"noopener noreferrer\">security<\/a> takeover in the state in 2018, police and military officers killed <\/span><a href=\"https:\/\/glo.bo\/2ZNAcNB\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">1,534 people<\/span><\/a><span style=\"font-weight: 400;\">, amounting to 28% of the homicides that year. Around 17 million people live in the state. In 2019, police killed <\/span><a href=\"https:\/\/glo.bo\/2MzD6hw\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">1,814 people<\/span><\/a><span style=\"font-weight: 400;\"> under newly elected governor Wilson Witzel, who told police to \u201caim at the little heads\u201d of criminal offenders and \u201cfire.\u201d Killings by police accounted for almost 40% of homicides in the state last year.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At the online panel, Wallace Corbo of NGO <a href=\"https:\/\/bit.ly\/3jvXRKe\" target=\"_blank\" rel=\"noopener noreferrer\">Educafro<\/a> called the state\u2019s security policies \u201cgenocidal.\u201d Many panelists emphasized the disproportionate toll of such policies on Afro-descendent Brazilians. Though around <\/span><a href=\"https:\/\/bit.ly\/3hq0pYQ\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">56% of Brazil\u2019s population<\/span><\/a><span style=\"font-weight: 400;\"> is black or brown, <\/span><a href=\"https:\/\/glo.bo\/2LTkkkX\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">80% of people killed by police<\/span><\/a><span style=\"font-weight: 400;\"> in the state of Rio in the first half of 2019 were black or brown. The percentage is consistent with sustained figures over many years; a 2015 <\/span><span style=\"font-weight: 400;\">analysis<\/span><span style=\"font-weight: 400;\"> by state legislators of 3,421 police killings since 2010 found <a href=\"https:\/\/bit.ly\/2E4EfNb\" target=\"_blank\" rel=\"noopener noreferrer\">80% of the victims<\/a> were black or brown.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2020\/07\/ISP-Taxa-Mortes-Agentes-do-Estado.png\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-60815\" title=\"Rate of police killings by population of state of Rio (police killings per 100,000 residents). Source: Instituto de Seguran\u00e7a P\u00fablica\" width=\"620\" height=\"351\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/07\/ISP-Taxa-Mortes-Agentes-do-Estado.png 1858w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/07\/ISP-Taxa-Mortes-Agentes-do-Estado-300x170.png 300w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/07\/ISP-Taxa-Mortes-Agentes-do-Estado-1024x580.png 1024w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/07\/ISP-Taxa-Mortes-Agentes-do-Estado-768x435.png 768w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/07\/ISP-Taxa-Mortes-Agentes-do-Estado-1536x870.png 1536w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/07\/ISP-Taxa-Mortes-Agentes-do-Estado-174x98.png 174w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">Despite the frequency with which police in Rio de Janeiro kill people, forensics teams tasked with investigating these deaths operate on a <\/span><a href=\"https:\/\/nyti.ms\/2X9wXxw\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">shoestring budget<\/span><\/a><span style=\"font-weight: 400;\"> and there is <\/span><span style=\"font-weight: 400;\">no concerted government effort<\/span><span style=\"font-weight: 400;\"> to monitor the operations during which many of these deaths occur. That task falls to nongovernmental monitoring groups like the <\/span><a href=\"https:\/\/bit.ly\/2Me0OA1\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Fogo Cruzado<\/span><\/a><span style=\"font-weight: 400;\"> data collection platform, the <\/span><a href=\"https:\/\/bit.ly\/32I7Iab\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Network of Security Observatories<\/span><\/a><span style=\"font-weight: 400;\"> (ROS), and the <\/span><a href=\"http:\/\/bit.ly\/36wGGSz\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Center of Studies of Security and Citizenship<\/span><\/a><span style=\"font-weight: 400;\"> (CESeC) at C\u00e2ndido Mendes University. They track newspapers, news sites, social media networks and individual sources, sharing regular reports and analysis.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In March, as the new coronavirus arrived in Brazil, Rio police operations and killings <\/span><a href=\"https:\/\/bit.ly\/2A3SZtA\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">dramatically decreased<\/span><\/a><span style=\"font-weight: 400;\">. But in April and May, police killings spiked, rising higher than the totals for the same months in already record-breaking 2019. May was also marked by a series of <\/span><span style=\"font-weight: 400;\">police killings of teenagers<\/span><span style=\"font-weight: 400;\">, including 14-year-old Jo\u00e3o Pedro Mattos Pinho in <\/span><a href=\"http:\/\/bit.ly\/2SVjMhr\" target=\"_blank\" rel=\"noopener noreferrer\">S\u00e3o Gon\u00e7alo<\/a><span style=\"font-weight: 400;\">\u00a0and an operation which <\/span><a href=\"https:\/\/bit.ly\/2ABSs2w\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">killed 13 people<\/span><\/a><span style=\"font-weight: 400;\"> in Complexo do Alem\u00e3o. These same police operations had been regularly interrupting <\/span><a href=\"https:\/\/bit.ly\/2ASQsTH\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">community Covid-19 relief efforts<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cNow is the time to take care of people in need of basic food supplies,\u201d said Eliene Vieira, an activist with the group <\/span><a href=\"https:\/\/bit.ly\/32OgtQ5\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Mothers of Manguinhos<\/span><\/a><span style=\"font-weight: 400;\">, \u201cnot for taking advantage of this time when everyone is inside their homes to [show off] military power.\u201d<\/span><\/p>\n<h3>A Landmark Legal Challenge<\/h3>\n<p><span style=\"font-weight: 400;\">In 2019, in response to the security policies of newly elected Rio governor Witzel, human rights lawyers partnered with the\u00a0Brazilian Socialist Party (PSB) to mount a legal challenge against those policies that soon gained the support of a coalition of civil society groups. It took the form of a <\/span><a href=\"https:\/\/bit.ly\/2WI6qIr\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Claim of Noncompliance with a Fundamental Order<\/span><\/a><span style=\"font-weight: 400;\"> (ADPF), an allegation that a government body has violated a fundamental element of the Brazilian constitution.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This ADPF, number 635, has come to be referred to as the ADPF das Favelas (The Favelas\u2019 ADPF), and is historic in its recognition of favela collectives as <\/span><i><span style=\"font-weight: 400;\">amici curiae <\/span><\/i><span style=\"font-weight: 400;\">(collaborators with the court based on their special expertise). The <\/span><a href=\"https:\/\/www.facebook.com\/redecontraviolenciarj\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Network of Communities and Movements Against Violence<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/bit.ly\/3fuiyDU\" target=\"_blank\" rel=\"noopener noreferrer\">Coletivo Papo Reto<\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"http:\/\/bit.ly\/1vou8Fg\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Redes da Mar\u00e9<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"http:\/\/bit.ly\/2Dx68rd\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Coletivo Fala Akari<\/span><\/a><span style=\"font-weight: 400;\">, <\/span>Mothers of Manguinhos, and the <a href=\"http:\/\/bit.ly\/2EvQfpl\" target=\"_blank\" rel=\"noopener noreferrer\">Right to Memory and Racial Justice Initiative<\/a><span style=\"font-weight: 400;\"> are the <\/span><a href=\"https:\/\/bit.ly\/2ZN0MXe\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">first groups from favelas<\/span><\/a><span style=\"font-weight: 400;\"> to participate in a lawsuit against the State of Rio de Janeiro in the Supreme Court.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The subject of the ADPF das Favelas <\/span><a href=\"http:\/\/redir.stf.jus.br\/estfvisualizadorpub\/jsp\/consultarprocessoeletronico\/ConsultarProcessoEletronico.jsf?seqobjetoincidente=5816502\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">lawsuit<\/span><\/a><span style=\"font-weight: 400;\"> is \u201cexcessive and growing police lethality\u201d in the state of Rio de Janeiro, \u201cdirected, above all, against the black and poor population of favelas.\u201d It cites \u201cthe relationship between structural racism and police lethality.\u201d The <\/span><i><span style=\"font-weight: 400;\">amici curiae, <\/span><\/i><span style=\"font-weight: 400;\">including the favela collectives, the Rio de Janeiro State <a href=\"http:\/\/bit.ly\/2LrztMk\" target=\"_blank\" rel=\"noopener noreferrer\">Public Defender\u2019s Office<\/a>, the <a href=\"http:\/\/bit.ly\/2qh5mLa\" target=\"_blank\" rel=\"noopener noreferrer\">Unified Black Movement (MNU)<\/a>, and human rights organizations <a href=\"https:\/\/bit.ly\/2CueFRw\" target=\"_blank\" rel=\"noopener noreferrer\">Conectas<\/a>, <a href=\"http:\/\/bit.ly\/2N2lbjx\" target=\"_blank\" rel=\"noopener noreferrer\">Justi\u00e7a Global<\/a>, and <a href=\"http:\/\/bit.ly\/2Jdwwx6\" target=\"_blank\" rel=\"noopener noreferrer\">ISER<\/a>, wrote in an April 16 <\/span><a href=\"https:\/\/bit.ly\/2E4EfNb\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">brief<\/span><\/a><span style=\"font-weight: 400;\"> that the actions of the Rio police threatened \u201csocially vulnerable groups\u201d including \u201cfavela residents, black people, poor people, children, adolescents, young people, the elderly, women, and police.\u201d They wrote that actions by Rio\u2019s police have violated the UN\u2019s Code of Conduct for Law Enforcement Officials, which stipulates that use of force should be proportional, exceptional, and only deployed when absolutely necessary.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2020\/07\/Live-ADPF.png\"><img decoding=\"async\" class=\"aligncenter wp-image-60816\" title=\"Online discussion between legal teams and amici curiae in ADPF das Favelas\" src=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2020\/07\/Live-ADPF.png\" alt=\"\" width=\"620\" height=\"348\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/07\/Live-ADPF.png 1778w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/07\/Live-ADPF-300x168.png 300w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/07\/Live-ADPF-174x98.png 174w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">The lawsuit calls for measures such as limiting police operations in the proximity of schools, day cares, and health centers, reducing sweeping warrants for forced police entry into homes, prohibiting shooting downward into residential areas from helicopters, ensuring first aid for people injured in police operations, preserving crime scenes after the operations, improving external control over police actions by the state public prosecutor, and an end to government encouragement of police violence.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cI would like the STF to see this with the eyes of the favela,\u201d Vieira said. \u201cWe are subjects with rights and every time there are these operations inside favelas, our rights are violated.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, she said that during the pandemic, children who would usually spend their days inside a school building are in their homes or in city streets, and thus at higher risk of being shot during daytime police incursions: \u201cWhen the operations happen, the first to be hit [with bullets] are the children.\u201d Activist Renata Trajano of <\/span><span style=\"font-weight: 400;\">Coletivo Papo Reto<\/span><span style=\"font-weight: 400;\"> and the <\/span><a href=\"https:\/\/bit.ly\/FavelaCovidCampaigns\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Alem\u00e3o Crisis Center<\/span><\/a><span style=\"font-weight: 400;\"> called for the Court to approve the ADPF das Favelas so that \u201cyoung people can sit in the alley by their houses and have a chat [\u2026] without having to have a gun aiming at their heads the whole time.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On April 17, Supreme Court Justice Edson Fachin, who is overseeing the case and was the first to issue an opinion, <\/span><a href=\"https:\/\/bit.ly\/3fRoGGy\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">voted<\/span><\/a><span style=\"font-weight: 400;\"> in favor of enforcing several of its requests, including those on restricting the use of police helicopters, preserving crime scenes, restricting operations near schools and health centers, and guaranteeing external investigations of police suspected of committing crimes. He also voted to suspend a decree by Witzel that had halted bonuses for police whose record showed a reduction in the number of citizens they killed.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As the Supreme Court case slowly continued, with other judges yet to issue their opinions, lethal police actions continued in April and early May. <\/span><a href=\"https:\/\/bit.ly\/39Efpj9\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Analysis by ROS<\/span><\/a><span style=\"font-weight: 400;\"> found that Rio police killed 57.9% more people in April 2020 than they did in April 2019, and by May 19, the police had killed 16.7% more people than they did in the first 19 days of May 2019.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In response, on May 26, the team behind the ADPF filed a <\/span><a href=\"https:\/\/bit.ly\/3eMkqXP\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">petition for an emergency temporary order<\/span><\/a><span style=\"font-weight: 400;\"> to suspend police operations during the pandemic except in \u201cabsolutely exceptional\u201d circumstances which must be justified in advance to the public defender\u2019s office, and in which \u201cexceptional care\u201d must be taken not to put favela residents and services in a position of \u201ceven greater risk\u201d. The document made explicit and detailed reference to the killing of 13 people in Complexo do Alem\u00e3o on May 15, the death of 14-year-old Mattos Pinho on May 18 inside his aunt\u2019s home\u2014and in the company of five other adolescents\u2014the death of Iago C\u00e9sar dos Reis Gonzaga, 21, allegedly tortured before police shot him in <a href=\"http:\/\/bit.ly\/2D61vag\" target=\"_blank\" rel=\"noopener noreferrer\">Acari<\/a>, and the May 21 death of 19-year-old student Rodrigo Cerqueira, killed amid a distribution session of emergency Covid-19 food relief to residents of <a href=\"http:\/\/bit.ly\/1P6dPbm\">Morro da Provid\u00eancia<\/a>.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On June 5, Fachin issued the <\/span><a href=\"https:\/\/bit.ly\/3eQenBl\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">emergency temporary order<\/span><\/a><span style=\"font-weight: 400;\">\u2014reserved for cases where rights are in immediate and serious danger\u2014suspending police operations in Rio favelas for the duration of the pandemic.\u00a0<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">This is the first
