{"id":62711,"date":"2021-06-11T10:59:49","date_gmt":"2021-06-11T13:59:49","guid":{"rendered":"https:\/\/www.rioonwatch.org\/?p=62711"},"modified":"2021-10-21T09:37:22","modified_gmt":"2021-10-21T12:37:22","slug":"community-land-trusts-and-the-struggle-for-the-right-to-the-city-dialogue-on-rio-and-mozambique-backdated","status":"publish","type":"post","link":"https:\/\/rioonwatch.org\/?p=62711","title":{"rendered":"Community Land Trusts and the Struggle for the Right to the City: Dialogue on Rio and Mozambique"},"content":{"rendered":"<p style=\"text-align: right;\"><a href=\"https:\/\/bit.ly\/31Y7WZl\" target=\"_blank\" rel=\"noopener noreferrer\"><em><strong>Clique aqui para Portugu\u00eas<\/strong><\/em><\/a><a href=\"https:\/\/bit.ly\/32ShEhs\"><img decoding=\"async\" width=\"20\" height=\"20\" class=\"alignright wp-image-23766 size-full\" src=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2012\/08\/PT-e1439583827971.png\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">As part of the activities of <\/span><a href=\"https:\/\/bit.ly\/36oSNlc\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">UN-Habitat<\/span><\/a><span style=\"font-weight: 400;\">\u2019s <\/span><a href=\"http:\/\/bit.ly\/2J5hFnp\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">2020 Urban Circuit<\/span><\/a><span style=\"font-weight: 400;\">, the <\/span><a href=\"http:\/\/bit.ly\/2ZwWT63\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Community Land Trust (CLT)<\/span><\/a><span style=\"font-weight: 400;\"> Working Group held a livestreamed virtual event on October 20, 2020, facilitated by <\/span><a href=\"http:\/\/bit.ly\/2KEWrin\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Catalytic Communities (CatComm)<\/span><\/a><span style=\"font-weight: 400;\">*, entitled \u201c<\/span><a href=\"https:\/\/bit.ly\/2TEjJI1\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">The Community Land Trust As an Instrument of Urban Transformation: A Debate With Experiences of Rio de Janeiro and Mozambique<\/span><\/a><span style=\"font-weight: 400;\">.\u201d The event featured two researchers and four Rio de Janeiro community leaders, all involved in the struggle for the right to the city. They presented some of their experiences working with the topic and discussed <\/span><a href=\"http:\/\/bit.ly\/2AUyfSc\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">how CLTs can contribute to this fight<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The event was moderated by Felipe Litsek, a researcher, lawyer, and assistant to the CLT Working Group, and featured Ailton Lopes, second secretary of the Residents\u2019 Association of the <\/span><a href=\"https:\/\/bit.ly\/2GL0OZ7\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Trapicheiros<\/span><\/a><span style=\"font-weight: 400;\"> favela in <\/span><a href=\"http:\/\/bit.ly\/30mMPwy\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Tijuca<\/span><\/a><span style=\"font-weight: 400;\">; Eleonora Dobles, a UN-Habitat Program Assistant who studied Metropolitan Governance and did field research on informal land markets in Maputo, <\/span><a href=\"https:\/\/bit.ly\/32ucAyw\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Mozambique<\/span><\/a><span style=\"font-weight: 400;\">; Marcello Deodoro, a member of the <\/span><a href=\"https:\/\/bit.ly\/35cGycg\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Indiana<\/span><\/a><span style=\"font-weight: 400;\"> favela&#8217;s Residents\u2019 Commission in Tijuca and participant in Rio&#8217;s\u00a0<\/span><a href=\"https:\/\/bit.ly\/3keYibk\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Popular Council<\/span><\/a><span style=\"font-weight: 400;\">; <\/span><a href=\"https:\/\/bit.ly\/2IfUc5j\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Maria da Penha<\/span><\/a><span style=\"font-weight: 400;\">, a resident of <\/span><a href=\"http:\/\/bit.ly\/2IpNNB7\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Vila Aut\u00f3dromo<\/span><\/a><span style=\"font-weight: 400;\"> and co-founder of the <\/span><a href=\"http:\/\/bit.ly\/2HVxGfk\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Evictions Museum<\/span><\/a><span style=\"font-weight: 400;\">; Neide Mattos, a resident of <\/span><a href=\"https:\/\/bit.ly\/3keIEfS\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Conjunto Esperan\u00e7a<\/span><\/a><span style=\"font-weight: 400;\"> in <\/span><a href=\"http:\/\/bit.ly\/2XOQjKT\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Col\u00f4nia Juliano Moreira<\/span><\/a><span style=\"font-weight: 400;\">, part of the <\/span><a href=\"https:\/\/bit.ly\/38szBpy\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Minha Casa Minha Vida-Entidades<\/span><\/a><span style=\"font-weight: 400;\"> public housing program; and <\/span><a href=\"https:\/\/bit.ly\/3khB0Bv\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Tarcyla Fidalgo<\/span><\/a><span style=\"font-weight: 400;\">, Rio de Janeiro&#8217;s\u00a0<\/span><a href=\"http:\/\/bit.ly\/35TsDoU\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">CLT Project<\/span><\/a><span style=\"font-weight: 400;\"> Coordinator and a doctoral student in urban planning at <\/span><a href=\"http:\/\/bit.ly\/2IcZlIC\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">IPPUR<\/span><\/a><span style=\"font-weight: 400;\">&#8211;<\/span><a href=\"http:\/\/bit.ly\/2XiG2Ha\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">UFRJ<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><a href=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2020\/11\/2020-10-20-LIVE-TTC-Outubro-Urbano.png\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-62713\" src=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2020\/11\/2020-10-20-LIVE-TTC-Outubro-Urbano.png\" alt=\"\" width=\"620\" height=\"351\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/2020-10-20-LIVE-TTC-Outubro-Urbano.png 1719w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/2020-10-20-LIVE-TTC-Outubro-Urbano-300x170.png 300w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/2020-10-20-LIVE-TTC-Outubro-Urbano-1024x580.png 1024w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/2020-10-20-LIVE-TTC-Outubro-Urbano-768x435.png 768w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/2020-10-20-LIVE-TTC-Outubro-Urbano-1536x870.png 1536w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/2020-10-20-LIVE-TTC-Outubro-Urbano-174x98.png 174w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/span><\/p>\n<p><span style=\"font-weight: 400;\">As Lopes explained, the event \u201cbrought understanding to those who did not know about CLTs and expanded the knowledge of those who already did.\u201d The event demonstrated that even in different contexts, such as those of Brazil and Mozambique, the same <\/span><a href=\"http:\/\/bit.ly\/2NeE0U3\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">threats of eviction and gentrification<\/span><\/a><span style=\"font-weight: 400;\"> exist, despite the fact that, in Mozambique\u2019s case, land is state owned. In Brazil\u2019s case, where CLTs are being introduced in an ongoing process, the community leaders engaged in the CLT Working Group gave exciting testimonials emphasizing what they are seeking from the instrument: <\/span><a href=\"http:\/\/bit.ly\/2NfHs0K\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">legal protection<\/span><\/a><span style=\"font-weight: 400;\"> to be able to remain on their land, resisting removal either by the state or market forces, and tools to strengthen and maintain community organizing.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In her presentation about <\/span><a href=\"http:\/\/bit.ly\/2BvZPZj\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">what CLTs really are and how they work<\/span><\/a><span style=\"font-weight: 400;\">, Fidalgo explained that, above all, a CLT is an instrument to guarantee tenure security for vulnerable populations. It deals with a model of collective land management, characterized by separation between collective ownership of land and individual ownership of houses and buildings. By combining legal, social and urban planning actions, CLTs aim guarantee the tenure of residents in their homes and offer permanent affordable housing for low-income families.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The land is owned by the CLT, which is a local non-profit organization formed by residents and managed collectively. The house, its upgrades and yard, belong to individual residents by means of surface rights, which are formalized by a notary public. This way, when they become surface-rights title-holders to their houses, residents have the right to use them as they see fit, and are able to sell, rent or pass them on as inheritance to family members. The land, however, is permanently withdrawn from the market, which maintains the housing permanently affordable.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The cycle of mega-events in Rio de Janeiro brought the biggest wave of evictions in the city&#8217;s history, and, according to Fidalgo, it demonstrated that the titling options currently available are <\/span><a href=\"http:\/\/bit.ly\/2Nub7n5\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">no guarantee of permanence<\/span><\/a><span style=\"font-weight: 400;\"> in the territory. Entire communities, with or without titles, suffered from evictions either caused by the State and its repressive apparatus, or by the market, when, due to <\/span><a href=\"https:\/\/bit.ly\/2JN9SO5\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">gentrification and real estate speculation<\/span><\/a><span style=\"font-weight: 400;\">, an area\u2019s living standards increased or pressure was put on residents to sell their homes to entrepreneurs, forcing residents to move. It was due to these issues, and inspired by the <\/span><a href=\"http:\/\/bit.ly\/2qbzmqo\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">success story<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><a href=\"http:\/\/bit.ly\/2LjM5Wy\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Fideicomiso de la Tierra del Ca\u00f1o Mart\u00edn Pe\u00f1a<\/span><\/a><span style=\"font-weight: 400;\"> in San Juan, <\/span><a href=\"https:\/\/bit.ly\/3n5xo7x\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Puerto Rico<\/span><\/a><span style=\"font-weight: 400;\">\u2014the first <\/span><a href=\"https:\/\/bit.ly\/2Id0Jyd\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">CLT in Latin America<\/span><\/a><span style=\"font-weight: 400;\"> and one of the <\/span><a href=\"http:\/\/bit.ly\/30MOhbr\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">few implemented in favelas<\/span><\/a><span style=\"font-weight: 400;\"> in the world\u2014that CatComm developed the CLT Project. It aims to <\/span><a href=\"http:\/\/bit.ly\/2o1P4Iq\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">make the tool a reality for Rio favelas<\/span><\/a><span style=\"font-weight: 400;\">, demonstrating its potential and working to implement it in the city.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><a href=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2020\/11\/Martns-Pena.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-62714 size-content\" title=\"Members of Ca\u00f1o Mart\u00edn Pe\u00f1a in San Juan, Puerto Rico\" src=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2020\/11\/Martns-Pena-620x264.jpg\" alt=\"\" width=\"620\" height=\"264\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/Martns-Pena-620x264.jpg 620w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/Martns-Pena-940x400.jpg 940w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Despite the differences, Dobles stressed that the similarities between Mozambique and Brazil are striking. In addition to Portuguese colonization and certain joint cultural heritages, urban precariousness is a common feature in both countries: \u201cThe majority of Maputo, the capital of Mozambique, is occupied by informal communities known as <\/span><i><span style=\"font-weight: 400;\">cani\u00e7os<\/span><\/i><span style=\"font-weight: 400;\">, most of them located on the outskirts of the city and very similar to Brazilian favelas.\u2019\u2019<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Since the country&#8217;s independence in 1975, the new Mozambican government has prioritized land nationalization: land became state property and its sale is prohibited. There is no ownership, but instead a right of occupation known as the <\/span><i><span style=\"font-weight: 400;\">Duat<\/span><\/i><span style=\"font-weight: 400;\"> (Right to Use and Take Advantage of Land). \u201cThe Mozambican Land Law of 1979 is considered one of the most progressive land laws in the world. Through a designated social function of property, communities in addition to individuals can be legally guaranteed the collective right to use and take advantage of the land with the <\/span><i><span style=\"font-weight: 400;\">Duat,<\/span><\/i><span style=\"font-weight: 400;\">\u201d said Dobles.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Recent legislation, however, has partially modified the law, allowing the exchange and sale of <\/span><i><span style=\"font-weight: 400;\">Duats<\/span><\/i><span style=\"font-weight: 400;\">, and now it is no longer possible to avoid a common problem in cities around the world: <\/span><a href=\"https:\/\/bit.ly\/3pgA0kH\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">gentrification<\/span><\/a><span style=\"font-weight: 400;\">. \u201c<\/span><i><span style=\"font-weight: 400;\">Polana Cani\u00e7o<\/span><\/i><span style=\"font-weight: 400;\"> is the most striking example,\u201d said Dobles. This coastal and central neighborhood of Maputo was traditionally inhabited by low-income populations, but for some years now, in the name of supposed urban regeneration and due to flooding dangers, residents have been moved to peripheral areas of the city, opening up land in an area highly valued for real estate speculation. This process is <\/span><a href=\"http:\/\/bit.ly\/292sUu0\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">very familiar to citizens of Rio<\/span><\/a><span style=\"font-weight: 400;\">. According to Dobles, the CLT model has everything needed to help combat such speculative pressure dynamics occurring in Maputo.<\/span><\/p>\n<p><iframe src=\"https:\/\/www.youtube.com\/embed\/2YJKTqZ5bkg\" width=\"620\" height=\"349\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>All of the community leaders present at the event had experienced threats of eviction, and from the similarities with the Mozambican situation, they emphasized their desire to stay in their neighborhoods and hopes that the CLT would help establish legal pathways to that end. Lopes, a resident of Trapicheiros favela, <a href=\"https:\/\/bit.ly\/2DErQQc\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">one of the first two pilot communities<\/span><\/a><span style=\"font-weight: 400;\"> of the CLT Project, said \u201cHere [in Trapicheiros] belonging to the favela holds great importance. Many residents were born here and want to live here, and that&#8217;s where their grandparents were born and still live today. I was delighted with the CLT. It\u2019s a distinguished tool, a form of protection: we will no longer be a fragile community. We will be shielded against the threats of gentrification, real estate speculation, and evictions, and we will strengthen our sense of community.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Neide, a resident of Conjunto Esperan\u00e7a, the <\/span><a href=\"https:\/\/bit.ly\/2FiaIjK\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">other pilot community<\/span><\/a><span style=\"font-weight: 400;\"> of the CLT Project, says she worries a great deal about the future: \u201cWe don&#8217;t have land title yet. I am very afraid that 20 years of history will be lost due to real estate speculation. The CLT came as a lifeline. It will bring us a collective title and a solid foundation to ensure that we remain on this land and that I can pass on my home, my trophy, to my son.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When asked about the importance of communities staying organized, and how to make the favelas true parts of the city, the leaders of the favelas present were unanimous in stating that it is through community mobilization and the strengthening of pride and social identity of favela residents that the stigma attached to favelas can be overcome.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><a href=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2020\/11\/Trapicheiros.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-62716\" title=\"Meeting of the CLT Project in the community of Trapicheiros\" src=\"https:\/\/www.rioonwatch.org\/wp-content\/uploads\/2020\/11\/Trapicheiros.jpg\" alt=\"\" width=\"620\" height=\"307\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/Trapicheiros.jpg 1600w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/Trapicheiros-300x148.jpg 300w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/Trapicheiros-1024x506.jpg 1024w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/Trapicheiros-768x380.jpg 768w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2020\/11\/Trapicheiros-1536x759.jpg 1536w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Deodoro, an activist in the community of Indiana, said that the main problem with favelas is their social invisibility: \u201cIt is necessary to show to those who do not live in favelas that we exist, we have potential, and we have a voice. It is necessary to cultivate the identity of the favelas, so that we are not ashamed of who we are,\u201d he said. \u201cAnd also to keep the community active in society, participating in councils, forums, public hearings, promoting solidarity and sustainable economies. All of this reveals our community to people from the outside who come to get to know us and contribute to our struggle. We have to <\/span><a href=\"https:\/\/bit.ly\/3pgCT4W\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">remove this stigma<\/span><\/a><span style=\"font-weight: 400;\"> that the favela is a lost territory.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Penha, a <\/span><a href=\"http:\/\/bit.ly\/30ngpTk\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">well-known community leader<\/span><\/a><span style=\"font-weight: 400;\"> from Vila Aut\u00f3dromo, also said that she is very proud to be from the favela: \u201cWe may be poor in terms of money, but we are rich in experiences, in solidarity, and in love in our hearts. We are not afraid of life. We face life with dignity. Every favela has to be proud of its place.\u201d She also spoke of the importance of popular self-organization and the exchange of experiences that is possible through visiting other communities: \u201cFavela residents need to have this knowledge of their rights. In our struggle, for example, we created the <\/span><a href=\"http:\/\/bit.ly\/2ObbL5S\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Evictions Museum<\/span><\/a><span style=\"font-weight: 400;\"> together with educators and residents. Our museum has two purposes: to keep the memory of the residents who are gone, and to be a tool against evictions.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mattos added that nothing can be achieved alone, saying it is necessary to unite and organize: \u201cThe community&#8217;s ability to organize itself is its strength in the future. Just one little bird doesn&#8217;t make it summertime.
