There\u2019s been a swath of <a href=\"http:\/\/bit.ly\/Y52nQo\">land titles being handed out<\/a>, the arrival of new services such as a <a href=\"http:\/\/bit.ly\/Y1vfpW\">Family Clinic in Complexo da Penha<\/a> and a <a href=\"http:\/\/bit.ly\/TjVXYt\">cinema in Nova Brasilia<\/a>, and youth programmes such as <a href=\"http:\/\/glo.bo\/YBrkCz\">UPP Fight<\/a>, a martial arts club in Andara\u00ed.<\/p>\n<p>But what UPP giveth with one hand, with the other it taketh away. Or that, at least, is the experience of residents organizing their own events in the community. Because of an archaic piece of legislation called Resolution 013, passed in 2007 by Secretary of State Security and UPP chief architect, Jos\u00e9 Mariano Beltrame, <a href=\"http:\/\/bit.ly\/Nj71J9\" target=\"_blank\" rel=\"noopener\">cultural life<\/a> in UPP favelas has been walking on a tightrope since the police arrived.<\/p>\n<p>A baptism, a birthday party, a samba circle or a sports meet can, in theory, be shut down at the whim of UPP officers under Resolution 013. And when it does happen, there\u2019s no room for discussion, which has led to tensions boiling over between residents and police, <a href=\"http:\/\/bit.ly\/Wkxzym\">like in Santa Marta<\/a> and <a href=\"http:\/\/bit.ly\/13mPbeZ\">Turano, Rio Comprido<\/a>.<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/?attachment_id=7496\" rel=\"attachment wp-att-7496\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-7496 size-content\" title=\"UPP Turano\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2013\/03\/UPP-Turano-600x264.jpg\" width=\"600\" height=\"264\" \/><\/a><\/p>\n<p>What\u2019s more, cultural producers need to apply for licenses at least 20 days ahead of an event, and even so, it can be cancelled at the 11th hour if it\u2019s deemed a security risk. Silvana Bahia, writing for the <a href=\"http:\/\/bit.ly\/15jYiLC\">Observat\u00f3rio de Favelas<\/a>, notes, \u201cThe law is stirring controversy as it appears to be a violation of the freedom of expression, the access to culture, the right to assembly and freedom of association.&#8221;<\/p>\n<p>The biggest victims of Resolution 013, or \u201czero-treze\u201d as it\u2019s known, have been the <em>bailes funk <\/em>(funk parties), and to a lesser extent, the <em>pagodes <\/em>(samba get-togethers). These nighttime revelries have all but disappeared off the map in communities where UPP has erected its blue-and-white hoardings and installed its bulletproof vested officers. The silence at weekends is hard for some residents to get used to.<\/p>\n<p>Funk has been in more or less open conflict with the authorities for at least a decade, a result of the scene\u2019s historic ties to the drug factions. But the music is much richer and diverse than the stereotypes it\u2019s been saddled with. In fact, in 2009, with the passage of <a href=\"http:\/\/bit.ly\/12F9zbS\">Lei Funk \u00e9 Cultura<\/a> (Funk Is Culture Law), funk became part of Rio de Janeiro\u2019s official cultural heritage, which makes the current blackout all the harder to grasp.<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/?attachment_id=7502\" rel=\"attachment wp-att-7502\"><img decoding=\"async\" class=\"aligncenter wp-image-7502 size-full\" title=\"An outdoor baile funk in unpacified Complexo do Lins, North Zone\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2013\/03\/rio_baile_funk.jpg\" alt=\"An outdoor baile funk in unpacified Complexo do Lins, North Zone\" width=\"630\" height=\"419\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2013\/03\/rio_baile_funk.jpg 630w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2013\/03\/rio_baile_funk-300x199.jpg 300w\" sizes=\"(max-width: 630px) 100vw, 630px\" \/><\/a><\/p>\n<p>It\u2019s not unreasonable to expect the authorities to want to minimize security risks on the <em>morros <\/em>(the hills, where many of Rio\u2019s favelas are built), and Resolution 013, on the surface, is a risk assessment such as any professional event organizer should be familiar with. The awful tragedy at the Kiss nightclub in <a href=\"http:\/\/huff.to\/W3uOzZ\">Santa Maria<\/a> demonstrates the need for such precautions.<\/p>\n<p>The trouble with 013 is that it\u2019s a bureaucratic mountain for small-time cultural producers. In addition, it was <a href=\"http:\/\/bit.ly\/Y1vlOv\">passed without consultation<\/a>, and its blanket ban on funk is outright discriminatory. As Colonel Luigi Gatto from the Military Police said at <a href=\"http:\/\/bit.ly\/Xc5c3E\">a public consultation to discuss 013<\/a>, \u201cFunk is necessary, it\u2019s legitimate, and it can\u2019t be illegal.\u201d<\/p>\n<p>To stage an indoor event in a UPP favela, organizers now need to complete eight separate documents. For an outdoor event, it\u2019s 18. Amongst some of the requirements, for example, \u201cis a copy of a letter requesting the trimming of trees in the area around the venue,\u201d according to an article in <a href=\"http:\/\/bit.ly\/XHwj2U\"><em>Overmundo<\/em> magazine<\/a>.<\/p>\n<p>Moreover, in the absence of any clear official policy on approvals, the UPP commanders are left to make decisions at their own discretion. <a href=\"http:\/\/bit.ly\/15RSzxL\">Greg Scruggs<\/a>, writing for <em><a href=\"http:\/\/bit.ly\/WiNe0U\">Cluster Mag<\/a><\/em>, notes, \u201c013 is selectively wielded by the UPP and largely depends on the personality of the captain in that favela, leading to a kind of capriciousness depressingly similar to the era of the narco-traffickers, when the boss\u2019s word was law.\u201d<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/?attachment_id=7510\" rel=\"attachment wp-att-7510\"><img decoding=\"async\" class=\"aligncenter wp-image-7510 size-content\" title=\"MC Leonardo (left) at Apafunk organized funk event\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2013\/03\/apafunk-620x264.jpg\" alt=\"MC Leonardo (left) at Apafunk organized funk event\" width=\"620\" height=\"264\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2013\/03\/apafunk-620x264.jpg 620w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2013\/03\/apafunk-940x400.jpg 940w\" sizes=\"(max-width: 620px) 100vw, 620px\" \/><\/a><\/p>\n<p>Leading the lobby to repeal Resolution 013 is the <a href=\"http:\/\/bit.ly\/SgJ83E\">Associa\u00e7\u00e3o dos Profissionais e Amigos do Funk (Apafunk)<\/a>, a loose organization of individuals representing the funk scene. Its president is MC Leonardo, one of the icons of the 1990s funk scene, best known for <a href=\"http:\/\/bit.ly\/Y8BpaY\">\u2018Rap do Centen\u00e1rio\u2019<\/a>. For MC Leonardo, the irony of 013 is impossible to ignore. \u201cFunk can be played anywhere in Rio de Janeiro, except in the place where it comes from: the favela.\u201d<\/p>\n<p>With\u00a0lawyers at the Get\u00falio Vargas Foundation (FGV), and representatives from the Secretary of Security, Apafunk formed part of a working group to redraft Resolution 013. Luiz Moncau, from FGV, explains, \u201cIt\u2019s vital to create legislation that allows for differences, so that it doesn\u2019t privilege cultural producers with large budgets.&#8221;<\/p>\n<p>Apafunk has also been organizing monthly Roda de Funk events around the city to promote awareness of 013 through music and debates. \u201cThe Roda de Funk is one of the main weapons we have to spread information,\u201d Apafunk\u2019s MC Teko told Observat\u00f3rio de Favelas. \u201cAs well as showing that there\u2019s much more to funk than the way the media represent it, it\u2019s also a way for us to get more involved. We use social networks a lot, since we can\u2019t depend on the media to debate these issues.\u201d<\/p>\n<p>The issues at stake are many. The most obvious is why matters of culture in the communities are being vetted by the police. As photographer\u00a0<a href=\"http:\/\/bit.ly\/Y3KdNg\">L\u00e9o Lima<\/a>, from Jacarezinho, states: \u201cCriteria need to be established so that there is a specific organ for these matters. The Military Police cannot be the last resort on this issue.\u201d<\/p>\n<p><a href=\"http:\/\/www.rioonwatch.org\/?attachment_id=7513\" rel=\"attachment wp-att-7513\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-7513 size-medium\" title=\"Baile Funk in Ladeira dos Tabajaras\" src=\"http:\/\/www.rioonwatch.org\/wp-content\/uploads\/2013\/03\/mcleonardo-300x199.jpg\" alt=\"Baile Funk in Ladeira dos Tabajaras\" width=\"300\" height=\"199\" srcset=\"https:\/\/rioonwatch.org\/wp-content\/uploads\/2013\/03\/mcleonardo-300x199.jpg 300w, https:\/\/rioonwatch.org\/wp-content\/uploads\/2013\/03\/mcleonardo.jpg 500w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>In some places, the UPP are relaxing their stance. There has been a weekly baile funk in Zona Sul\u2019s Tabajaras for some months. <a href=\"http:\/\/bit.ly\/12cpz4F\">Another recent one<\/a> in Nova Bras\u00edlia, Complexo do Alem\u00e3o, went ahead in a partnership between UPP and the local residents\u2019 association. Sponsorship from a beer company ensured the event was free.<\/p>\n<p>For Major M\u00e1rcio Rodrigues, the UPP commander who came up with the idea, it\u2019s an extension of the Programme of Proximity, an attempt to narrow the gap between the police and the community. \u201cThis baile funk will be a watershed in the relations between the police and the community. With the success of the event, others will follow,\u201d he told <a href=\"http:\/\/bit.ly\/12cpz4F\">Voz das Comunidades<\/a>.<\/p>\n<p>Indeed, there seems to be recognition on both sides that something has to change so that residents have the freedom to create their own culture, rather than having it dictated by outside forces. What also has to disappear is the idea among some sections of the UPP that they\u2019re on a mission to teach the favelas what sort of culture is appropriate, <a href=\"http:\/\/bit.ly\/Y1vlOv\">as anthropologist Adriana Facina has argued<\/a>.<\/p>\n<p>For Apafunk, it\u2019s even simpler than that: \u201cWe can have a safer city, but one that preserves its identity, its charisma, its explosive popular culture. Or we can have a safer city, but one without grace, without innovation, without life.
